Reed &#038; Associates; and<br \/>\nWHEREAS the report states in part that \u201c\u2026.we consider the present condition of the structural instability of the noted building to be an emergency, we are recommending that the building be immediately demolished\u2026\u201d; and<br \/>\nWHEREAS under Section 247 of the Municipal Act allows that \u201c..in an emergency a municipality may take whatever actions or measures are necessary to eliminate the emergency. and \u201cthe costs of actions or measures taken to eliminate an emergency \u2026.may be collected by the municipality in the same manner as a tax may be collected or enforced under this Act.\u201d\u201d;<br \/>\nTHEREFORE BE IT RESOLVED that the Village of Benito take the necessary action to have the building demolished and add the costs of the engineering firm who provided the assessment, the costs of the contractor and the associated legal costs with respect to this matter to the tax roll for the property.<br \/>\nCarried.<\/p>\n<p>2.<br \/>\nSCHNEIDER<br \/>\nZEBINSKI<br \/>\nBE IT RESOLVED that the Village of Benito accept the tender from Intermountain Contracting Ltd. to demolish the following structures as per quote attached hereto as Schedule \u201cA\u201d:<br \/>\n&#8211; The structure on the property in the Village of Benito described as Desc 5\/6 Block 1 Plan 362; and<br \/>\n&#8211; The structure on the property in the Village of Benito described as Lot 3 Block 2 Plan 362; and<br \/>\nBE IT FURTHER RESOLVED that the following conditions shall apply:<br \/>\n&#8211; That as per the recommendation of C.A. Reed and Associates the demolition of said building at Desc 5\/6 Block 1 Plan 362 will be supervised by an engineer from the firm that conducted the assessment.<br \/>\n&#8211; That the contractor shall be compliant with all Workplace Safety and Health regulations as required;<br \/>\n&#8211; That all materials be sorted as per Environmental regulations;<br \/>\n&#8211; That the contractor is responsible for the proper disposal of cement<br \/>\n&#8211; That water &#038; sewer lines be capped and marked for future location;<br \/>\n&#8211; That the basements be filled and topped with 6\u201d topsoil; and<br \/>\n&#8211; That the property be leveled smooth<br \/>\nCarried.<\/p>\n<p>3.<br \/>\nOFFENBERGER<br \/>\nZEBINSKI<br \/>\nWHEREAS the Village of Benito requires a repair to sewer line and installation of water line infrastructure within the Village; and<br \/>\nWHEREAS the Village has received one tender for the required work;<br \/>\nTHEREFORE BE IT RESOLVED that T&#038;T Trenching &#038; Exc. Ltd. be contracted to do the necessary work as per quote attached hereto.<br \/>\nCarried.<\/p>\n<p>4.<br \/>\nSCHNEIDER<br \/>\nZEBINSKI<br \/>\nRESOLVED that Pacak Kowal Hardie &#038; Company of Swan River, Manitoba be appointed as the Village of Benito Auditor for the Audit years 2010, 2011 and 2012.<br \/>\nCarried.<\/p>\n<p>5.<br \/>\nOFFENBERGER<br \/>\nZEBINSKI<br \/>\nRESOLVED that we do adjourn the meeting at 10:15 pm.<br \/>\nCarried<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A Special Meeting of Council of the Village of Benito was called to order at 9:45 pm on Monday October 3, 2011 in the Village of Benito Drop In Centre.
