Nielsen re: Swan Valley RISE Presentation<\/p>\n<p>Additions to the Agenda:<br \/>\n\t6.0\tAnimal Control Report for September, 2016<br \/>\n\t7.3\tResolutions from Benito LUD Committee<\/p>\n<p>1.\tCARRIE BLOSHA<br \/>\n\tBRIAN BURICK<br \/>\nRESOLVED that we do hereby acknowledge Councillor Potten\u2019s absence from this evening\u2019s meeting as approved at the Regular Meeting of Council held on the 11th day of October, 2016 by the members of Council for the Municipality of Swan Valley West.<br \/>\n\tCarried:\t<\/p>\n<p>2.\tGLEN FOSTER<br \/>\n\tDAVID MINISH<br \/>\nRESOLVED that the Agenda for the Regular Meeting of Council held this 25th day of October, 2016 shall be adopted as amended.<br \/>\nCarried:<\/p>\n<p>3.\tCARRIE BLOSHA<br \/>\n\tBRIAN BURICK<br \/>\nRESOLVED that the Council for the Municipality of Swan Valley West shall hereby call to order the Public Hearing regarding the application for Conditional Use regarding the property known as the SE \u00bc of Section 21-34-29wpm at 7:05 p.m.<br \/>\nCarried: <\/p>\n<p>4.\tTERRY NEELY<br \/>\n\tDAVID MINISH<br \/>\nRESOLVED that written notice of absence, which includes approval for the meeting to proceed in his absence, has been received from Councillor, Stan Potten regarding Special Meetings of Council and shall be hereby acknowledged this 25th day of October, 2016 by the Council for the Municipality of Swan Valley West.<br \/>\nCarried:<\/p>\n<p>List of Public Persons in attendance is attached hereto.<\/p>\n<p>Reeve, Verne Scouten opened the Public Hearing and welcomed those in attendance.<\/p>\n<p>CAO, Carolyn Gordon reviewed the rules of order for the hearing and the details    regarding the application for the conditional use. An invitation was made to those in attendance to make presentations or to ask any questions they may have regarding the proposed conditional use. Members of council were invited to ask questions and provide comments regarding the conditional use application. The applicant answered any questions posed by members of council. No written or oral objections were received.<\/p>\n<p>Reeve Verne Scouten then thanked those who attended and participated in the discussion.<\/p>\n<p>5.\tBRIAN BURICK<br \/>\n\tTERRY NEELY<br \/>\nRESOLVED that this Public Hearing shall now adjourn at 7:15 p.m.<br \/>\nCarried:\t<\/p>\n<p>6.\tBRIAN BURICK<br \/>\n\tCARRIE BLOSHA<br \/>\nRESOLVED the Regular Meeting of the Council for the Municipality of Swan Valley West shall now re-open at 7:15 p.m. to proceed with the regular business of council.<br \/>\nCarried:<\/p>\n<p>7.\tBRIAN BURICK<br \/>\n\tCARRIE BLOSHA<br \/>\nRESOLVED that the Minutes for the Regular Meetings of the Council for the Municipality of Swan Valley West held on September 27th, 2016 and October 11th, 2016 and the Special Meetings of Council held on October 4th, 2016 and October 14th, 2016 shall be adopted as circulated.<br \/>\nCarried:<\/p>\n<p>8.\tBRIAN BURICK<br \/>\n\tCARRIE BLOSHA<br \/>\nRESOLVED that the Rural PW Report for the period ending October 24th, 2016 as submitted by the Superintendent of Public Works shall be received by the Council for the Municipality of Swan Valley West.<br \/>\nCarried:<\/p>\n<p>9.\tCARRIE BLOSHA<br \/>\n\tBRIAN BURICK<br \/>\nWHEREAS there are Flood Sites from 2014 that are waiting for engineering reports and could not be completed due to inclimate weather;<br \/>\nTHEREFORE BE IT RESOLVED that we do hereby request an extension for the submission of final claims to EMO under the DFA program to October 1st, 2017.<br \/>\nCarried:<\/p>\n<p>10.\tGLEN FOSTER<br \/>\n\tTERRY NEELY<br \/>\nWHEREAS an application was submitted to the Municipality for a Conditional Use \tPermit on the SE \u00bc of Section 21-34-29wpm to provide for the construction of a cabin \tas allowed under Table 4-1 \u201cAG\u201d Agricultural General Zone, Use and Bulk Table as part \tof the Rural Municipality of Swan River Zoning By-Law #2383-04, and;<br \/>\nWHEREAS such construction is classified as a \u2018Conditional Use\u2019 on the aforementioned \tTable and notice of the Public Hearing was posted and delivered to adjacent \tlandowners as required under The Planning Act, and;<br \/>\nWHEREAS no objections have been received;<br \/>\nNOW THEREFORE BE IT RESOLVED that Council for the Municipality of Swan Valley \tWest does hereby approve said application, subject to any conditions that may be set \tout in the \u2018Conditional Use Approval\u2019 document, a copy of which is attached hereto, \tand;<br \/>\nBE IT FURTHER RESOLVED that the CAO shall be authorized to sign the \taforementioned \u2018Conditional Use Approval\u2019 on behalf of the Municipality.<br \/>\nCarried:<\/p>\n<p>11.\tCARRIE BLOSHA<br \/>\n\tTERRY NEELY<br \/>\nWHEREAS the owner of N.W. \u00bc SEC. 30-36-27WPM has made application to subdivide their property, and;<br \/>\nWHEREAS the Council for the Municipality of Swan Valley West has reviewed said application, along with the letter received from Community and Regional Planning dated October 19th, 2016 and have no objections to the aforementioned subdivision;<br \/>\nTHEREFORE BE IT RESOLVED we do hereby approve the subdivision of the above noted property, provided all requirements are met as noted by the following;<br \/>\n\t&#8211; Comments from Manitoba Conservation (Environment \u2013 Onsite Wastewater \t   Management)<br \/>\n\t&#8211; Correspondence from Manitoba Hydro (Easement)<br \/>\nCarried:\t<\/p>\n<p>12.\tTERRY NEELY<br \/>\n\tGLEN FOSTER<br \/>\nWHEREAS the Council for the Municipality of Swan Valley West recognizes the increase in requests for Access to Information as well as the need to Protect Personal Privacy, and have reviewed the new Policy regarding \u2018Procedures for Access to Information\u2019;<br \/>\nTHEREFORE BE IT RESOLVED that we do hereby agree to adopt the new Municipal Policy entitled \u2018Procedures-Access to Information\u2019 as presented.<br \/>\nCarried:\t<\/p>\n<p>13.\tTERRY NEELY<br \/>\n\tGLEN FOSTER<br \/>\nWHEREAS Subsection 10(4) of The Municipal Councils and School Boards Election Act states that \u201cif the office of senior election official becomes vacant, the elected authority must immediately appoint a successor\u201d, and;<br \/>\nWHEREAS it has recently been brought to the Cao\u2019s attention that a senior election official was appointed by Resolution of the Council for the Municipality of Swan Valley West on January 27th, 2015 for the 2015 by-election only;<br \/>\nTHEREFORE BE IT RESOLVED that we do hereby agree to advertise the position of \u2018Senior Election Official\u2019 for the Municipality of Swan Valley West as soon as possible and shall select the best candidate for said position upon review of all applications and a formal interview process.<br \/>\nCarried: <\/p>\n<p>14.\tTERRY NEELY<br \/>\n\tCARRIE BLOSHA<br \/>\nWHEREAS Resolution No.13 dated September 27th, 2016 was passed by the Council for the Municipality of Swan Valley West regarding an Application to Construct Water Control Works on the land known as the NE \u00bc &#038; NW \u00bc of Section 8-35-28WPM and;<br \/>\nWHEREAS there was a typing error made when entering the legal description on the original application;<br \/>\nTHEREFORE BE IT RESOLVED that we do hereby approve the correction of the legal description on said application and acknowledge that the land in the Municipality of Swan Valley West should read \u2018the NE \u00bc &#038; NW \u00bc of Section 8-35-27WPM, and;<br \/>\nBE IT FURTHER RESOLVED that the corrected application shall be submitted to Manitoba Conservation and Water Stewardship for consideration.<br \/>\nCarried:<\/p>\n<p>15.\tBRIAN BURICK<br \/>\n\tTERRY NEELY<br \/>\nRESOLVED the Council for the Municipality of Swan Valley West does hereby agree to provide Municipal Landowners Approval for the Applications for License to Construct Water Control Works on the following property where said works cause surface water to enter into the municipal ditches, as indicated on the maps submitted with said applications to the Province of Manitoba;<br \/>\n\t&#8211; SE \u00bc Section 24-36-28WPM<br \/>\n\t&#8211; NW \u00bc Section 13-36-28WPM<br \/>\nAND BE IT FURTHER RESOLVED that all drainage works shall conform with the terms and conditions set by the Province of Manitoba, and any works outside those shown on the aforementioned application shall be identified and brought to council for approval of additional drainage into the municipal ditch prior to commencing construction of the same, and;<br \/>\nBE IT FURTHER RESOLVED that either the Reeve or the CAO shall be authorized to sign the Landowner Approval Sections of the Provincial Applications to Construct Water Control Works and the Municipal Landowner Agreement &#038; Liability Release Form (where applicable) on behalf of the Municipality.<br \/>\nCarried:<\/p>\n<p>16.\tCARRIE BLOSHA<br \/>\n\tBRIAN BURICK<br \/>\nWHEREAS the Council for the Municipality of Swan Valley West agrees that it is important to recognize the sacrifices made by those Military Veterans who have served and are still serving our country, as well as their families;<br \/>\nTHEREFORE BE IT RESOLVED that we do hereby approve the purchase of the annual \u00bc page ad in the Military Service Recognition Book in 2017 and the same shall be included in the 2017 Budget.<br \/>\nCarried:<\/p>\n<p>17.\tGLEN FOSTER<br \/>\n\tDAVID MINISH<br \/>\nWHEREAS the Regular Meeting of the Council for the Municipality of Swan Valley West set for November 22nd, 2016 falls on the second day of the AMM Convention;<br \/>\nTHEREFORE BE IT RESOLVED that we do hereby agree to move said meeting of council by one week to November 29th, 2016 at 7:00 pm. and shall post an ad for the public in both municipal offices immediately to alert the public of the change in this regular meeting date.<br \/>\nCarried:\t<\/p>\n<p>18.\tCARRIE BLOSHA<br \/>\n\tBRIAN BURICK<br \/>\n\tRESOLVED the Rural Animal Control Report for the month of September, 2016 shall be \treceived, and that payment for said services shall be approved as submitted.<br \/>\nCarried:<\/p>\n<p>19.\tTERRY NEELY<br \/>\n\tGLEN FOSTER<br \/>\nRESOLVED that the Council for the Municipality of Swan Valley West does hereby \tapprove the following payments:<br \/>\nGeneral Cheques #12802to #12839 in the amount of  $1,860,375.95<br \/>\nPayroll Cheques #1068 to #1086 in the amount of             $26,176.45<br \/>\nFor a Grand Total of \t\t\t\t          $1,886,552.40<br \/>\nCarried:<\/p>\n<p>20.\tBRIAN BURICK<br \/>\n\tCARRIE BLOSHA<br \/>\nRESOLVED that the Council for the Municipality of Swan Valley West does hereby receive the Bank Reconciliation for the period ending September 30th, 2016 and the Financial Statement for the period ending October 24th, 2016 as presented.<br \/>\nCarried:<\/p>\n<p>21.\tTERRY NEELY<br \/>\n\tDAVID MINISH<br \/>\nWHEREAS the members of Council for the Municipality of Swan Valley West have \treviewed and reconsidered the recommendation received from the CAO regarding \tEmployee Overtime and agree to the proposal as presented;<br \/>\nTHEREFORE BE IT RESOLVED that we do hereby accept said recommendation dated \tJune 21st, 2016 and shall authorize the CAO to offer the proposal as outlined in the \trecommendation.<br \/>\nCarried:<\/p>\n<p>22.\tBRIAN BURICK<br \/>\n\tCARRIE BLOSHA<br \/>\nRESOLVED that the Council for the Municipality of Swan Valley West shall receive the \tfollowing resolutions from the Benito LUD Committee;<br \/>\n&#8211; No.8 dated September 30th, 2016 regarding Swan Valley Settlement Services<br \/>\n&#8211; No.9 dated September 30th, 2016 regarding the Swan Valley Veterinary Clinic<br \/>\nCarried:<\/p>\n<p>23.\tGLEN FOSTER<br \/>\n\tCARRIE BLOSHA<br \/>\nRESOLVED that the Council for the Municipality of Swan Valley West shall receive the \tAge Friendly Meeting Report submitted by the Benito LUD Committee Chair, William \tZebinski.<br \/>\nCarried:<\/p>\n<p>24.\tCARRIE BLOSHA<br \/>\n\tTERRY NEELY<br \/>\nRESOLVED that the CAO and all members of Council for the Municipality of Swan \tValley West shall be authorized to attend the Doctor Recruitment Meeting to be held \ton November 3rd, 2016 at 6:00 pm in the Legion Room at the War Veterans Hall.<br \/>\nCarried:<\/p>\n<p>25.\tGLEN FOSTER<br \/>\n\tBRIAN BURICK<br \/>\nRESOLVED that we do hereby accept the following verbal reports regarding Council \tCommittees and Communications;<br \/>\n&#8211; Councillor Neely reported on the Shared Service meetings with the Town of Swan \t  River and Minitonas-Bowsman and Swan Valley RISE<br \/>\n&#8211; Councillor Foster had no report<br \/>\n&#8211; Reeve Scouten Reported on the Two Shared Service Meetings<br \/>\nCarried:<\/p>\n<p>26.\tBRIAN BURICK<br \/>\n\tCARRIE BLOSHA<br \/>\n\tRESOLVED that pursuant to Section 152(3) of the Municipal Act, the Council as a \twhole shall go into camera and close the meeting to the public to discuss Shared \tServices, Boundary Road Agreement and Employee Related Issues.<br \/>\nCarried:<\/p>\n<p>27.\tTERRY NEELY<br \/>\n\tBRIAN BURICK<br \/>\nRESOLVED that pursuant to Section 152 (4) of the Municipal Act, this meeting shall be \tre-opened to the public.<br \/>\nCarried:<\/p>\n<p>28.\t BRIAN BURICK<br \/>\n\tCARRIE BLOSHA<br \/>\nWHEREAS the Council for the Municipality of Swan Valley West has reviewed the \tterms and conditions outlined in the Boundary Road Agreement received from the \tMunicipality of Minitonas-Bowsman and wish to propose changes to the proposed \tagreement;<br \/>\nTHEREFORE BE IT RESOLVED that we do hereby agree to submit a request to the \tCouncil for the Municipality of Minitonas-Bowsman to give consideration to proposed \tamendments to the aforementioned Agreement and shall table their final decision \tuntil such time as a response has been received.<br \/>\nCarried:<\/p>\n<p>29.\tGLEN FOSTER<br \/>\n\tTERRY NEELY<br \/>\nWHEREAS three invoices dated July 27th, 2015 were received on October 17th, 2016 \tfor application of gravel on Boundary Rd#157W between the following locations;<br \/>\n&#8211;
