Village of Benito Minutes – January 14, 2014

A Regular Meeting of Council of the Village of Benito was called to order at 7:00 pm on Tuesday January 14, 2014 in the Village Council Chambers.

Present: Mayor Meadows;
Deputy Mayor Scouten;

Councilor Zebinski; Councilor Offenberger; Councilor Schneider

Chief Administrative Officer ~ Pat Ellingson.

Mayor Meadows called the meeting to order at 7:00 pm

1. ZEBINSKI
SCOUTEN
RESOLVED that the minutes of the Regular Meeting of Council held on December 10, 2013 be adopted as presented.
Carried.

2. SCHNEIDER
OFFENBERGER
RESOLVED that the agenda for the Regular meeting held on January 14, 2014 be adopted as presented.
Carried.

3. SCOUTEN
SCHNEIDER
RESOLVED that the accounts numbered 25096 to 25195 in the amount totaling $67,032.98 be ratified as paid.
Carried.

4. SCOUTEN
ZEBINSKI
WHEREAS the Village’s Animal Control Officer has on numerous occasions, been contacted by Village residents to remove problem dogs from their properties; and
WHEREAS the Village of Benito has incurred costs when the Animal Control Officer has to respond to complaints regarding these dogs, which belong to rural residents, being at large in the Village;
THEREFORE BE IT RESOLVED that the CAO be authorized to invoice the respective dog owners for the costs incurred.

SCOUTEN
WHEREAS the Village of Benito and the Village of Arran entered into an agreement, signed by both municipalities in 2001, whereby the Benito Fire Department provided protection and assistance to the Village of Arran in the prevention and suppression of fires; and
WHEREAS the Village of Benito has deemed that the Fire Agreement has become outdated and in need of updating; and
WHEREAS the updated agreement was forwarded to the Village of Arran and has subsequently received approval and has been signed, sealed and dated by the authorized signatories of the Village of Arran;
THEREFORE BE IT RESOLVED that the Village of Benito authorized the Mayor and Chief Administrative Officer of the Village of Benito to sign, date and affix the seal of the Village of Benito to the aforementioned agreement to provide fire protection to the Village of Arran.

6. SCHNEIDER

WHEREAS the Village of Benito and the R.M. of Livingston entered into an agreement, signed by both municipalities in 2001, whereby the Benito Fire Department provided protection and assistance to the to the R.M. of Livingston in the prevention and suppression of fires; and
WHEREAS the Village of Benito has deemed that the Fire Agreement has become outdated and in need of updating; and
WHEREAS the updated agreement was forwarded to the R.M. of Livingston and has subsequently received approval and has been signed, sealed and dated by the authorized signatories of the R.M. of Livingston;
THEREFORE BE IT RESOLVED that the Village of Benito authorized the Mayor and Chief Administrative Officer of the Village of Benito to sign, date and affix the seal of the Village of Benito to the aforementioned agreement to provide fire protection to the R.M. of Livingston.

7. ZEBINSKI
SCOUTEN
WHEREAS Bill 33, The Municipal Modernization Act, has been passed by the Legislative Assembly; and
WHEREAS The Municipal Modernization Act requires municipalities with fewer than 1,000 residents to develop an amalgamation plan jointly with their amalgamation partners; and
WHEREAS the Village of Benito has a population of less than 1,000 residents; and therefore must partner with the Rural Municipality of Swan River per the requirements of The Municipal Modernization Act; and
WHEREAS the councils of the Village of Benito and the Rual Municipality of Swan have met jointly to discuss and negotiate amalgamation issues; and
WHEREAS the two municipalities have prepared an amalgamation plan and the said amalgamation plan has met the requirements of The Municipal Modernization Act;
THEREFORE BE IT RESOLVED THAT the council of the Village of Benito forward the attached amalgamation plan, along with the cover letter stating our strong objection to Forced Amalgamation, to the Department of Municipal Government for Final review and approval as legally required by Bill 33, The Municipal Modernization Act

BE IT RESOLVED that the Village appoint Bernice Bowley of Winnipeg, Manitoba as the Village Solicitor for the Year 2014; and
BE IT FURTHER RESOLVED that payment for service will be as per Schedule “A” attached hereto.

9. SCHNEIDER
SCOUTEN
RESOLVED that the Village of Benito authorize payment of the balance of 2013 School Tax Levies as follows:
Swan Valley School Division Levy $7,851.84
Provincial Education Support Levy $1,836.00
Carried.

10. ZEBINSKI
SCOUTEN
RESOLVED that the year 2013 be the designated year with regards to the Village of Benito 2014 Tax Sale; and
BE IT FURTHER RESOLVED THAT all properties with taxes owing for any portion of the year 2012 or prior shall be offered for sale by public auction at 10:00 a.m. on Thursday November 13, 2014 in order to recover tax arrears and all associated costs; and
BE IT FURTHER RESOLVED that Taxervice is hereby authorized to conduct the 2014 Tax Sale on behalf of the Village of Benito.

11. OFFENBERGER

RESOLVED that the Village of Benito make application to the Department of Transportation and Government Services for a 50/50 Grant-In-Aid towards shaping and application of road stabilizer on Government Road Allowance from Highway 83 East to Main Street for an estimated cost of $1000.00.

12. ZEBINSKI
SCOUTEN
RESOLVED that the Village of Benito shall authorize the CAO to apply for two Summer Student positions under the Hometown Green Team Program for the period of May 1st, 2014 to August 31, 2014. Carried.

13. SCHNEIDER
OFFENBERGER
RESOLVED that the Village of Benito authorize payment of invoices attached hereto as Schedule “A”.
Carried.

14. SCOUTEN
ZEBINSKI
RESOLVED that the Village of Benito accept the quote attached hereto as Schedule “A” for repairs for the Ford C-600 Compactor truck.
Carried.

15. SCHNEIDER
SCOUTEN
RESOLVED that the annual Village of Benito ad be authorized for publication in the January Bundles of Joy supplement of the Star & Times. Carried.

16. OFFENBERGER
ZEBINSKI
WHEREAS the December employee overtime reports have been received and reviewed by council;
BE IT RESOLVED that the overtime hours recorded be accepted as presented and be approved for payment as attached hereto.

RESOLVED that we do adjourn the Regular Meeting of Council at 10:30 pm.
