RESOLVED THAT the Agenda be adopted as amended.

RESOLVED THAT Garry Bartel shall be appointed as Finance Chair for this council meeting.

RESOLVED THAT the minutes of the Regular Meeting of Council held on August 7th, 2018 and the Special Meeting of Council held on August 10th, 2018 shall be adopted as circulated.

RESOLVED THAT we do hereby authorize payment of the List of Accounts numbered 5322 to 5516 inclusive, amounting to $1,062,262.18.

RESOLVED THAT the Financial Statement for the month ending July 31st, 2018 shall be approved as presented.

6. L. Hutman – G. Bartel
RESOLVED THAT the Council of the Municipality of Minitonas-Bowsman does hereby approve the Staff Expense Reports as submitted.

7. L. Hutman – J. Caruk
RESOLVED THAT we do hereby accept the attached resignation letter from Tricia Kereluik as the Office Clerk and Senior Election Official, effective August 29th, 2018 with regrets.

8. G. Bartel – S. Walmsley
WHEREAS section 10 of The Municipal Councils and School Board Elections Act requires each municipality to appoint a Senior Elections Official (SEO) who will manage and conduct all aspects of the municipal election; and
WHEREAS Tricia Kereluik was originally hired as the SEO and had resigned as of August 29th, 2018
THEREFORE BE IT RESOLVED THAT Kasey Chartrand shall be hired as the SEO for the Municipality of Minitonas-Bowsman and that that previous contract be cancelled.
BE IT FURTHER RESOLVED THAT Reeve, Clint Eisner shall be authorized to sign the agreement with Kasey Chartrand, establishing the duties and remuneration for the SEO as attached hereto.

9. G. Bartel – L. Hutman
RESOLVED THAT the Council does hereby authorize Cassandra Manaigre to apply to enter the Manitoba Municipal Administration Program offered through the University of Manitoba.
BE IT FURTHER RESOLVED THAT all applicable expenses related to program will be paid for by the Municipality in accordance with the Employee Handbook & Policies.

10. S. Walmsley – L. Hutman
WHEREAS the Community & Regional Planning Branch has reviewed the application for subdivision of PT of NE ¼ of 24-35-27WPM (LJK CATTLE & GRAIN LTD) on behalf of the municipality and finds it to be in compliance with the Zoning By-Law for the RM of Minitonas; and
WHEREAS the proposed subdivision meets the provincial criteria for a subdivision; and
WHEREAS the application has been reviewed by the Council of the Municipality of Minitonas-Bowsman, and found to be acceptable by the members of council;
THEREFORE BE IT RESOLVED THAT the Council of the Municipality of Minitonas-Bowsman does hereby approve the subdivision of the aforementioned parcel of land on the condition that all requirements from all Provincial Government Departments are met as per the details submitted to the Municipality by Manitoba Municipal Relations, Community & Regional Planning services dated May 14th, 2018.

WHEREAS the Community & Regional Planning Branch has reviewed the application for subdivision of PT of SW ¼ of Sec. 2-37-25WPM (EICHLER) on behalf of the municipality and finds it to be in compliance with the Zoning By-Law for the RM of Minitonas; and
WHEREAS the proposed subdivision meets the provincial criteria for a subdivision; and
WHEREAS the application has been reviewed by the Council of the Municipality of Minitonas-Bowsman, and found to be acceptable by the members of council;
THEREFORE BE IT RESOLVED THAT the Council of the Municipality of Minitonas-Bowsman does hereby approve the subdivision of the aforementioned parcel of land on the condition that all requirements from all Provincial Government Departments are met as per the details submitted to the Municipality by Manitoba Municipal Relations, Community & Regional Planning services dated June 14th, 2018.
BE IT FURTHER RESOLVED THAT approval is subject to the condition that a Variance Order is obtained allowing a subdivision greater than 10 acres in the “AG” Zone.

WHEREAS the Community & Regional Planning Branch has reviewed the application for a minor subdivision of PT of NE ¼ Sec. 36-35-26WPM (LAUSMAN) on behalf of the municipality and finds it to be in compliance with the Zoning By-Law for the RM of Minitonas; and
WHEREAS the proposed subdivision meets the provincial criteria for a minor subdivision; and
WHEREAS the application has been reviewed by the council of the Municipality of Minitonas-Bowsman, and found to be acceptable by the members of council;
THEREFORE BE IT RESOLVED THAT the Council of the Municipality of Minitonas-Bowsman does hereby approve the minor subdivision of the aforementioned parcel of land as per the details submitted to the Municipality by Manitoba Municipal Relations, Community & Regional Planning services dated August 10th, 2018.

RESOLVED THAT By-law No. 02/2017, being a by-law of the Municipality of Minitonas-Bowsman for the purpose of amending by-law 4/2004, being the Village of Bowsman Zoning By-Law, shall be read a third time this 21st day of August, 2018 A.D., signed by the Reeve, and signed and sealed by the Chief Administrative Officer.

RESOLVED THAT By-law No. 06/2018, being a by-law of the Municipality of Minitonas-Bowsman for the purpose of Animal Control within the municipality, shall be introduced and read a first time this 21st day of August, 2018 A.D.

15. G. Bartel – J. Caruk
WHEREAS Lonnie & Christina Armistead are the registered owners of the property located in the Municipality of Minitonas-Bowsman legally described as Lot 6 Plan 34525 (Minitonas); and
WHEREAS the registered owners have applied to the Municipality of Minitonas-Bowsman Council to vary specific provisions of the Town of Minitonas Zoning By-law No. 03/2004 as it applies to the above noted property, and namely to increase the height restriction of a fence in the front yard from 4 feet to 6 feet on the north side only; and
WHEREAS Council may issue a Variance Order pursuant to Part 6 of the Planning Act; and
WHEREAS Council has given careful consideration of the application and all representations made for or against the application at the required Public Hearing held on August 7th, 2018 in Minitonas, in the Province of Manitoba;
THEREFORE BE IT RESOLVED THAT the Council of the Municipality of Minitonas-Bowsman does hereby agree to approve the Variance.
BE IT FURTHER RESOLVED THAT approval shall expire in 12 months from the date of approval if it has not been acted upon within that time.
