Minutes of the Regular Council Meeting of the Rural Municipality of Mountain held Wednesday, November 8th, 2017 in the R.M. of Mountain Council Chambers in Birch River, Manitoba.

The meeting was called to order at 10:15 A.M. by Deputy Reeve Connie Forbes. Chair assumed by the Reeve Marvin Kovachik at 10:16 A.M., quorum being present.

BE IT RESOLVED THAT the Agenda for the November 8th, 2017 Regular Meeting of Council be adopted as amended.

BE IT RESOLVED THAT the Minutes of the Board of Revision held October 25th, 2017 be adopted as presented, all requirements having been complied with.

BE IT RESOLVED THAT the Minutes of the regular meeting of Council held October 25th, 2017 be adopted as amended, all requirements having been complied with.

BE IT RESOLVED THAT Council of the Rural Municipality of Mountain hereby authorize the Chief Administrative Officer to destroy Municipal Documents under the Manitoba Regulation 53/97 as per Schedule “A” attached hereto.

BE IT RESOLVED THAT Council of the Rural Municipality of Mountain hereby accept and approve the Financial Statement for the month ending October 31, 2017, as presented.

THEREFORE BE IT RESOLVED THAT the unpaid accounts Utility Accounts, presented in Schedule ‘A’ attached hereto, be added to the real property tax account of each account holder.

WHEREAS Section 365(2) of The Municipal Act states that Council may in any year designate the immediately preceding year or any earlier year as the year for which properties the taxes in respect of which are in arrears for the year must be offered for sale by auction to recover the tax arrears and costs;
BE IT RESOLVED THAT the Designated Year for which properties in arrears will be offered for sale by auction be 2016 (meaning all properties with outstanding taxes from the year 2015 or prior);
AND THAT “costs” shall be the actual costs for each parcel listed for 2015 arrears and administration fees of $50.00 as set forth in Regulation 50/97;
AND BE IT FURTHER RESOLVED THAT the 2017 tax sale be held November 15th, 2017 at 10:00 A.M. at the R.M. of Mountain Council Chambers;
AND THAT TAXervice of Swan River be authorized to conduct the 2017 Tax Sale for the Rural Municipality of Mountain.

BE IT RESOLVED THAT Council of the Rural Municipality of Mountain set a reserve bid in the amount of the tax arrears and costs in respect of all properties offered for sale by auction to recover tax arrears and costs [MA, Section 372].

BE IT RESOLVED THAT Council of the Rural Municipality of Mountain hereby enter into an agreement with MuniWare for Support Services for 2018 and Software License as attached;
AND THAT the Chief Administrative Officer be authorized to sign on behalf of the municipality.

Councillor Forbes declared an interest for Res. No. 416/17 and left the meeting.

RESOLVED THAT Cheque Nos. 20171365 to 20171430 be approved for payment in the amount of $471,615.72, including 5,997.04 for Council indemnities, as per By-Law 03/16, and Direct Deposit Payroll in the amount of 4,439.98 as attached hereto as Schedule A.
AND FURTHER BE IT RESOLVED THAT the direct payment of 5,113.45 for Receiver General October 2017 be approved for payment.

BE IT RESOLVED THAT Council of the Rural Municipality of Mountain hereby grant leave of absence for LUD Mafeking Committee Member C. Cook from the regular meetings of the LUD of Mafeking held:
September 4th, 2017;
October 5th, 2017; and
November 6th, 2017
Pursuant to The Municipal Act [94(1)(a)].

BE IT RESOLVED THAT Council of the Rural Municipality of Mountain hereby approve work orders #160/17 to #163/17 attached hereto.

BE IT RESOLVED THAT Council of the Rural Municipality of Mountain hereby accept the offer to purchase Lot #15/16 Plan 1069; in Birch River, MB [Roll #300668.000] from Kelly & Donald Johnson in the amount of $210.00;
Plus $465 legal and administration costs [1 parcel].

BE IT RESOLVED THAT Council of the Rural Municipality of Mountain hereby enter into a Service Agreement with PureSphera for the pickup and disposal of white goods, as attached hereto in Schedule ‘A’;
AND THAT the CAO be authorized to sign on behalf of the municipality.

WHEREAS Council has entered into an agreement to accept White Goods at all waste stations within the RM of Mountain;
THEREFORE BE IT RESOLVED THAT Council of the Rural Municipality of Mountain amend the Solid Waste Management Fee Policy to include White Goods as per Schedule ‘A’ attached hereto.

BE IT RESOLVED THAT Council of the Rural Municipality of Mountain hereby authorize the request of Northern Neighbors Seniors Centre for a new door per Building Code specs provided by the Building Inspector, attached hereto as Schedule ‘A’.

BE IT RESOLVED THAT Council of the Rural Municipality of Mountain investigate closure of the ‘Northern Neighbors’ building, with transfer to Birch River School to assist SVSD Board with repurposing considerations and vacancy issues.

WHEREAS the municipality has been notified the leaseholder would like to purchase the following LGD-Vested Crown Administered parcel:
SW 18-33-20 W (Roll # 108200.000)
THEREFORE BE IT RESOLVED THAT Council of the Rural Municipality of Mountain hereby:
Request CLPA transfer title back to the RM of Mountain to facilitate the sale to leaseholder(s).

BE IT RESOLVED THAT Council of the Rural Municipality of Mountain hereby accept the nomination of the Kolisnyk Family for the Community Service Award recognizing outstanding contributions of time, effort and resources for the benefit of others.

Councillor Wyatt left the meeting @ 2:50 P.M.

WHEREAS Section 152(3) of The Municipal Act and Section 8.8 as By-Law No. 01/16 authorize Council to close a meeting to the public to discuss certain matters;
AND WHEREAS Section 15.13 of By-Law #01/16, The Procedures By-Law of The Rural Municipality of Mountain, instructs a member to;
“…keep in confidence a matter that is discussed at a meeting closed to the public under subsection 152(3) of The Act until the matter is discussed at a council meeting conducted in public.”
BE IT RESOLVED THAT Council of the Rural Municipality of Mountain meet as a committee to discuss legal matters.

BE IT RESOLVED THAT Council of the Rural Municipality of Mountain hereby authorize the request of Bowsman & District Curling Club for a donation towards tables & chairs project in the amount of $100.00.
