Minutes of the Regular Council Meeting of the Rural Municipality of Mountain held Wednesday, April 5th, 2017 in the R.M. of Mountain Council Chambers in Birch River, Manitoba.

WHEREAS Section 152(3) of The Municipal Act authorizes Council to close a meeting to the public to discuss certain matters;
AND WHEREAS Section 15.13 of By-Law#01/11, The Procedures By-Law of The Rural Municipality of Mountain, instructs a member to;
“…keep in confidence a matter that is discussed at a meeting closed to
the public under subsection 152(3) of The Act until the matter is discussed
at a council meeting conducted in public.”
BE IT RESOLVED THAT Council of the Rural Municipality of Mountain meet as a committee to discuss legal matters.

WHEREAS Sensus Partnership of Chartered Professional Accountants has been appointed as the municipal auditor;
AND WHEREAS Sensus has prepared unaudited financial statements for Bellsite Recreation Commission for the year ended December 31, 2016, and presented them to Council for review and approval;
THEREFORE BE IT RESOLVED THAT Council of the Rural Municipality of Mountain hereby approve the unaudited 2016 financial statements as submitted, a copy of which is attached hereto as Schedule ‘A’.

AND WHEREAS Sensus has prepared unaudited financial statements for Cowan Recreation Commission for the year ended December 31, 2016, and presented them to Council for review and approval;
THEREFORE BE IT RESOLVED THAT Council of the Rural Municipality of Mountain hereby approve the unaudited 2016 financial statements as submitted, a copy of which is attached hereto as Schedule ‘A’.

WHEREAS an LUD must consult with Council before adopting its service plan [MA 119(2)];
AND WHEREAS the LUD of Mafeking has prepared and presented a service plan to Council;
THEREFORE BE IT RESOLVED THAT Council of the Rural Municipality of Mountain hereby adopt the service plan as submitted by the LUD of Mafeking [MA 120(1)(b)], attached hereto as Schedule ‘A’.

WHEREAS Fire Department Purchasing Policy states that all purchases of the Fire Department must be authorized by Council in advance;
THEREFORE BE IT RESOLVED THAT Council of the Rural Municipality of Mountain approve the purchase requests as per Schedule ‘A’ attached hereto CARRIED.

RESOLVED THAT Cheque Nos. 20170341 to 20170418 be approved for payment in the amount of $51,781.87, including 6,028.23 for Council indemnities, as per By-Law 03/16, and Direct Deposit Payroll in the amount of $3,808.25, attached hereto as Schedule ‘A’.
AND FURTHER BE IT RESOLVED THAT the direct payment amount of $7,201.52 for Receiver General March 2017 be approved for payment.

WHEREAS the Swan Valley is experiencing a long-term health care crisis;
AND WHEREAS healthcare programming is under review by the Provincial Government;
AND WHEREAS residents & taxpayers benefit significantly from reduced travel & expenses keeping family members in/near local communities;
AND WHEREAS additional care beds would reduce wait times;
BE IT RESOLVED THAT Council of the Rural Municipality of Mountain support the efforts of the MLA and Long-term Care Stakeholders in their efforts to expand local long-term care beds.

BE IT RESOLVED THAT Council of the Rural Municipality of Mountain hereby approve the Application(s) for Licence(s) to Construct Water Control Works as attached hereto in Schedule ‘A’.

WHEREAS The Highway Traffic Act authorizes a traffic authority to restrict the allowable weight of vehicles that use part or all of a highway or structure forming part of it [86(1)(c)], with or without conditions;
AND WHEREAS the restriction is for one year or less [86(3)(a)];
THEREFORE BE IT RESOLVED THAT Council of the Rural Municipality of Mountain hereby order weight restrictions on municipal roads as follows:
Effective April 5th, 2017;
Single axle and axle groups be 65% of normal;
Travelling or hauling during this time be reported and authorized by the Municipality;
School buses and emergency vehicles are exempt;
The Municipality be exempt in emergency situations.

BE IT RESOLVED THAT Council of the Rural Municipality of Mountain hereby approve Minor Subdivision No. 4617-17-7353 in the SE of 25-35-23 WPM (Harapiak);
With the following Conditions:
Overdue taxes, if any, are required to be paid as a condition of final approval;
Subdivision proposal meets all requirements of the municipal building by-law and Swan Valley Development Plan

BE IT RESOLVED THAT Council of the Rural Municipality of Mountain hereby accept the Request for Quotation from Frank Markin for 1959 Chev Pine River Fire Tanker as per Schedule ‘A’ attached hereto.
Subject to the following terms & conditions:
Received payment in full by quaranteed funds by April 20th, 2017 at RM Administration office

WHEREAS municipal policy states Fire Department equipment must only be used for fire protection, suppression, emergency services or training unless authorized by Resolution of Council;
AND WHEREAS the Swan Valley Mutual Aid District has requested use of our pumper(s) for training purposes in April as attached hereto in Schedule ‘A’;
THEREFORE BE IT RESOLVED THAT Council of the Rural Municipality of Mountain hereby authorize the District Fire Chief to make necessary arrangements to accommodate the Pump Basic Seminar while ensuring adequate fire protection for municipal residents.

BE IT RESOLVED THAT the Rural Municipality of Mountain hereby contract Wilson McQuay as Noxious Weeds Inspector per contract attached hereto as Schedule ‘A’,
AND that the Reeve and Chief Administrative Officer be authorized to sign on behalf of the Municipality.

BE IT RESOLVED THAT the Rural Municipality of Mountain hereby contract Ron Lewicki for 2017 Building Inspection Services per contract attached hereto as Schedule ‘A’.

BE IT RESOLVED THAT the Rural Municipality of Mountain hereby contract Carol Dutchak for 2017 Animal Control Services per contract attached hereto as Schedule ‘A’;
AND THAT the Reeve and Chief Administrative Officer be authorized to sign on behalf of the Municipality.

BE IT RESOLVED THAT the Rural Municipality of Mountain hereby contract Stephen Nadolney for 2017 Emergency Coordination Services per contract attached hereto as Schedule ‘A’;
AND THAT the Reeve and Chief Administrative Officer be authorized to sign on behalf of the Municipality.

WHEREAS substantial work is completed and in progress on the addition of MRI services to the Dauphin Regional Health Centre of Prairie Mountain Regional Health Authority;
AND WHEREAS the project is currently under review by the new Provincial Government;
AND WHEREAS our residents and taxpayers would benefit significantly from reduced travel time and expenses to travel for MRI services;
AND WHEREAS additional MRI services would reduce wait times in the Province;
AND WHEREAS significant Provincial funding invested would be wasted by not completing the project;
THEREFORE BE IT RESOLVED THAT Council of the Rural Municipality of Mountain support completion of the MRI project at the Dauphin Regional Health Centre;
THAT Council support the letter sponsored by the Rural Municipality of Dauphin to Honorable Kelvin Goertzen, Minister of Health, Seniors and Active Living in support of completing the MRI addition;
AND THAT the Reeve and CAO be authorized to sign on behalf of the municipality.

BE IT RESOLVED THAT Council of the Rural Municipality of Mountain hereby authorize the request of Birch River Busy Beavers 4-H Club for a donation in the amount of $100.00.

BE IT RESOLVED THAT the Regular Meeting of Council of the Rural Municipality of Mountain be adjourned to meet again on April 28th, 2017.
