Reeve, Verne Scouten opened the Public Hearing and welcomed those in attendance.
CAO, Carolyn Gordon reviewed the rules of order for the hearing and the details regarding the application for the conditional use. An invitation was made to those in attendance to make presentations or to ask any questions they may have regarding the proposed conditional use. Members of council were invited to ask questions and provide comments regarding the conditional use application. The applicant answered any questions posed by members of council. No written or oral objections were received.
Reeve Verne Scouten then thanked those who attended and participated in the discussion.

RESOLVED that the Rural PW Report for the period ending October 24th, 2016 as submitted by the Superintendent of Public Works shall be received by the Council for the Municipality of Swan Valley West.

WHEREAS there are Flood Sites from 2014 that are waiting for engineering reports and could not be completed due to inclimate weather;
THEREFORE BE IT RESOLVED that we do hereby request an extension for the submission of final claims to EMO under the DFA program to October 1st, 2017.

WHEREAS an application was submitted to the Municipality for a Conditional Use Permit on the SE ¼ of Section 21-34-29wpm to provide for the construction of a cabin as allowed under Table 4-1 “AG” Agricultural General Zone, Use and Bulk Table as part of the Rural Municipality of Swan River Zoning By-Law #2383-04, and;
WHEREAS such construction is classified as a ‘Conditional Use’ on the aforementioned Table and notice of the Public Hearing was posted and delivered to adjacent landowners as required under The Planning Act, and;
WHEREAS no objections have been received;
NOW THEREFORE BE IT RESOLVED that Council for the Municipality of Swan Valley West does hereby approve said application, subject to any conditions that may be set out in the ‘Conditional Use Approval’ document, a copy of which is attached hereto, and;
BE IT FURTHER RESOLVED that the CAO shall be authorized to sign the aforementioned ‘Conditional Use Approval’ on behalf of the Municipality.

WHEREAS the owner of N.W. ¼ SEC. 30-36-27WPM has made application to subdivide their property, and;
WHEREAS the Council for the Municipality of Swan Valley West has reviewed said application, along with the letter received from Community and Regional Planning dated October 19th, 2016 and have no objections to the aforementioned subdivision;
THEREFORE BE IT RESOLVED we do hereby approve the subdivision of the above noted property, provided all requirements are met as noted by the following;
– Comments from Manitoba Conservation (Environment – Onsite Wastewater Management)
– Correspondence from Manitoba Hydro (Easement)

WHEREAS the Council for the Municipality of Swan Valley West recognizes the increase in requests for Access to Information as well as the need to Protect Personal Privacy, and have reviewed the new Policy regarding ‘Procedures for Access to Information’;
THEREFORE BE IT RESOLVED that we do hereby agree to adopt the new Municipal Policy entitled ‘Procedures-Access to Information’ as presented.

WHEREAS Subsection 10(4) of The Municipal Councils and School Boards Election Act states that “if the office of senior election official becomes vacant, the elected authority must immediately appoint a successor”, and;
WHEREAS it has recently been brought to the Cao’s attention that a senior election official was appointed by Resolution of the Council for the Municipality of Swan Valley West on January 27th, 2015 for the 2015 by-election only;
THEREFORE BE IT RESOLVED that we do hereby agree to advertise the position of ‘Senior Election Official’ for the Municipality of Swan Valley West as soon as possible and shall select the best candidate for said position upon review of all applications and a formal interview process.

WHEREAS Resolution No.13 dated September 27th, 2016 was passed by the Council for the Municipality of Swan Valley West regarding an Application to Construct Water Control Works on the land known as the NE ¼ & NW ¼ of Section 8-35-28WPM and;
WHEREAS there was a typing error made when entering the legal description on the original application;
THEREFORE BE IT RESOLVED that we do hereby approve the correction of the legal description on said application and acknowledge that the land in the Municipality of Swan Valley West should read ‘the NE ¼ & NW ¼ of Section 8-35-27WPM, and;
BE IT FURTHER RESOLVED that the corrected application shall be submitted to Manitoba Conservation and Water Stewardship for consideration.

RESOLVED the Council for the Municipality of Swan Valley West does hereby agree to provide Municipal Landowners Approval for the Applications for License to Construct Water Control Works on the following property where said works cause surface water to enter into the municipal ditches, as indicated on the maps submitted with said applications to the Province of Manitoba;
– SE ¼ Section 24-36-28WPM
– NW ¼ Section 13-36-28WPM
AND BE IT FURTHER RESOLVED that all drainage works shall conform with the terms and conditions set by the Province of Manitoba, and any works outside those shown on the aforementioned application shall be identified and brought to council for approval of additional drainage into the municipal ditch prior to commencing construction of the same, and;
BE IT FURTHER RESOLVED that either the Reeve or the CAO shall be authorized to sign the Landowner Approval Sections of the Provincial Applications to Construct Water Control Works and the Municipal Landowner Agreement & Liability Release Form (where applicable) on behalf of the Municipality.

WHEREAS the Council for the Municipality of Swan Valley West agrees that it is important to recognize the sacrifices made by those Military Veterans who have served and are still serving our country, as well as their families;
THEREFORE BE IT RESOLVED that we do hereby approve the purchase of the annual ¼ page ad in the Military Service Recognition Book in 2017 and the same shall be included in the 2017 Budget.

WHEREAS the Regular Meeting of the Council for the Municipality of Swan Valley West set for November 22nd, 2016 falls on the second day of the AMM Convention;
THEREFORE BE IT RESOLVED that we do hereby agree to move said meeting of council by one week to November 29th, 2016 at 7:00 pm. and shall post an ad for the public in both municipal offices immediately to alert the public of the change in this regular meeting date.

WHEREAS the members of Council for the Municipality of Swan Valley West have reviewed and reconsidered the recommendation received from the CAO regarding Employee Overtime and agree to the proposal as presented;
THEREFORE BE IT RESOLVED that we do hereby accept said recommendation dated June 21st, 2016 and shall authorize the CAO to offer the proposal as outlined in the recommendation.

WHEREAS the Council for the Municipality of Swan Valley West has reviewed the terms and conditions outlined in the Boundary Road Agreement received from the Municipality of Minitonas-Bowsman and wish to propose changes to the proposed agreement;
THEREFORE BE IT RESOLVED that we do hereby agree to submit a request to the Council for the Municipality of Minitonas-Bowsman to give consideration to proposed amendments to the aforementioned Agreement and shall table their final decision until such time as a response has been received.
