Minutes of the Regular Council Meeting of the Rural Municipality of Mountain held Wednesday, January 13th, 2016 in the R.M. of Mountain Council Chambers in Birch River, Manitoba.

The meeting was called to order at 10:00 A.M. by Reeve Marvin Kovachik, quorum being present.

BE IT RESOLVED THAT the Agenda for the January 13th, 2016 Regular Meeting of Council be adopted as amended.

BE IT RESOLVED THAT the Minutes of the December 30th, 2015 Regular Meeting of Council be adopted as presented, all requirements having been complied with.

BE IT RESOLVED THAT Council of the Rural Municipality of Mountain hereby make Committee Appointments as per Schedule ‘A’ attached hereto.

WHEREAS written resignations of the elected officials of Ward 1 and Ward 2 have been received by the CAO and reported to council [MA, 104];
THEREFORE BE IT RESOLVED THAT Council of the Rural Municipality of Mountain direct the SEO to conduct by-elections to fill the vacancies [MA, 105].

WHEREAS Section 152(3) of The Municipal Act authorizes Council to close a meeting to the public to discuss certain matters;
BE IT RESOLVED THAT Council of the Rural Municipality of Mountain meet as a committee to discuss personnel.

BE IT RESOLVED THAT the meeting of the committee of the whole be adjourned, and that the regular meeting of Council of the Rural Municipality of Mountain be re-opened to the public.

WHEREAS Section 10(1) of The Municipal Councils and School Boards Elections Act requires each municipality to appoint a senior election official (SEO) who will be responsible to manage and conduct all aspects of municipal election;
AND WHEREAS the municipality is required to establish the rate of remuneration for the SEO;
THEREFORE BE IT RESOLVED THAT the CAO is hereby appointed to the position of SEO for the Rural Municipality of Mountain;
AND THAT the CAO will be paid pursuant to Resolution No. 508/15 to perform the duties of the SEO as set out in The Municipal Councils and School Boards Elections Act;
THAT Administration Staff appointed as Election Officials also be paid pursuant to Resolution No. 508/15;
AND THAT Voting Officials be paid minimum wage plus $2.00 per hour, plus mileage and expenses to perform the duties assigned.

WHEREAS Birch River Utility has incurred PSAB deficits;
AND WHEREAS Council has submitted By-Law No. 06/15, a rate study and application for revised rates to The Public Utilities Board (PUB);
AND WHEREAS it will take some time for PUB to process this application and ORDER revised rates while the utility continues to incur shortfalls;
BE IT RESOLVED THAT Council of the Rural Municipality of Mountain hereby request PUB to set interim rates for the Birch River Utility as attached hereto as Schedule ‘A’.

BE IT RESOLVED THAT Council of the Rural Municipality of Mountain hereby request PUB to set interim rates for the Mafeking Utility as attached hereto as Schedule ‘A’.

THEREFORE BE IT RESOLVED THAT Council of the RM of Mountain approve the purchase requests as per Schedule ‘A’ attached hereto.
