Minutes of the Regular Meeting of the Council of the Municipality of Swan Valley West, held in the Council Chamber at 216 Main Street West, Swan River, Manitoba on this 9th day of June, 2015 at 7:00 p.m.

RESOLVED that the Agenda for the Regular Meeting of Council held on Tuesday, June 9th, 2015 shall be adopted as amended.

RESOLVED that the minutes for the Regular Meeting of the Council for the Municipality of Swan Valley West held on May 26th, 2015 and the Public Hearing held on May 26th, 2015 shall be adopted as presented.

RESOLVED that the Public Works Foreman’s Report presented on June 9th, 2015 shall be accepted by Council, a copy of which is attached hereto.

WHEREAS gravel is being hauled from two locations with additional trucks, requiring another gravel checker;
THEREFORE BE IT RESOLVED that we do hereby agree to hire an additional gravel checker under the terms and conditions attached hereto.

RESOLVED that By-Law No.0012-15, being a by-law of the Municipality of Swan Valley West for the purpose of levying taxes for the 2015 Fiscal Year, shall be read a third time this 9th day of June, 2015, signed by the Reeve, and signed & sealed by the Interim-Acting CAO.

WHEREAS Conditional Approval has been granted by the Province of Manitoba, Community and Regional Planning for the subdivision of PT S.E. ¼ Sec. 18-36-27 WPM, File No. 4-193-14- 7176 and;
WHEREAS the Council for the Municipality of Swan Valley West has reviewed the terms and conditions of the attached Development Agreement between the municipality and the landowner, and are satisfied that it covers all recommendations provided by the Province of Manitoba;
THEREFORE BE IT RESOLVED that we do hereby agree to enter into the aforementioned agreement with Lance Delaurier and authorize the Reeve and Interim-Acting CAO to sign said agreement on behalf of the municipality.

RESOLVED that, after a careful review of the proposed ‘Media Relations Policy’, we do hereby agree to adopt said policy for the Municipality of Swan Valley West as amended, a copy of which is attached hereto.

WHEREAS the Owners of PT S.E. ¼ SEC. 31-35-28WPM have made application to subdivide an approximately 8.6 acre parcel which is surplus property and not necessary for their farm operation, and intended for sale as a rural residence, and;
WHEREAS the subject property is zoned “AG” Agricultural General according to the R.M. of Swan River Zoning By-Law #2383-04 and conforms with all minimum requirements, and;
WHEREAS Manitoba Infrastructure and Transportation has made a recommendation and the current owners and prospective purchasers be advised of the flood hazard, and that all future development at this location should proceed in strict accordance with Policies 2.3.6 regarding Sensitive Lands, Flooding, and Erosion Policies of the Swan Valley Planning District Development Plan;
THEREFORE BE IT RESOLVED that the Council for the Municipality of Swan Valley West does hereby approve said subdivision application with the aforementioned condition suggested by Manitoba Infrastructure and Transportation as noted in their report dated May 21st, 2015 a copy of which is attached hereto.

WHEREAS the owners of PT S.W. ¼ SEC.20-37-28WPM have made application to subdivide the parcel along the existing waterway that divides the land and sell the West portion of the parcel to an interested buyer, retaining ownership of the East portion, and;
WHEREAS the aforementioned subdivision has received ‘Conditional Approval’ provided that the requirements and conditions are met as set out in the letter issued May 25th, 2015 by Manitoba Community and Regional Planning, a copy of which is attached hereto;
THEREFORE BE IT RESOLVED that the Council for the Municipality of Swan Valley West does hereby approve said subdivision application with the attached requirements and conditions as set by Manitoba Community and Regional Planning.

RESOLVED that the following council members and employees are hereby authorized to attend the MGRA Gravel Road Design & Maintenance Seminar being held in Swan River on June 25th and June 26th, 2015;

RESOLVED that the attached 1/8 page ad shall be approved by council, congratulating the 2015 graduates.

RESOLVED that we do hereby agree to work with the Town of Swan River on a project to perform ‘crack sealing’/ pavement repairs on the following roadways in the municipality;
River Road
Willow Run Drive
West Wind Road
Potten Drive
BE IT FURTHER RESOLVED that the costs of said project shall be paid as set out in the 2015 Financial Plan, up to a maximum of $25,000.00 and covered by funding from the Municipal Paving Reserve.

WHEREAS the Council has reviewed their membership in the Swan Valley Recreation District and have agreed to retain their membership in the District;
THEREFORE BE IT RESOLVED that we do hereby agree to enter into the new agreement with the Province of Manitoba, the Town of Swan River and the Municipality of Minitonas- Bowsman for the years 2015, 2016, 2017 & 2018 and authorize the Reeve and Interim-Acting CAO to sign said agreement on behalf of the Municipality of Swan Valley West.

RESOLVED that, in accordance with the Manitoba Employment Standards, the Council for the Municipality of Swan Valley West does hereby agree to pay out the overtime incurred up to March 31st, 2015 as per the report attached hereto.

RESOLVED that the Council for the Municipality of Swan Valley West does hereby agree to accept the Animal Control Reports for May, 2015 and shall make payment to the Animal Control Officers as attached hereto.

WHEREAS the Council for the Municipality of Swan Valley West wishes to work with the Province of Manitoba and Nelson River Construction Inc. to provide access to Municipal Roadways for hauling materials required for Provincial Highway Contract No. 6404, and;
WHEREAS the best route from the gravel pit to Provincial Road #279 has been determined to be the 4.4 kilometers of Road #166W from Road #219N to Road #222N;
THEREFORE BE IT RESOLVED that we do hereby agree to enter into an agreement with Nelson River Construction Inc. as follows;
Nelson River Construction Inc. shall be responsible for the Municipal Transportation levy of $.24/cubic yard
Cook Brothers Cartage Ltd. Shall be responsible for the Municipal Aggregate Levy of $.19/cubic yard
Nelson River Construction Inc. shall be responsible for gravel, road maintenance, and application of dust control suppressant on the above noted 4.4 Kilometers of municipal roadways for the duration of the project
Municipality of Swan Valley West will assist with maintenance of said road at the same level as normally required
Nelson River Construction Inc. shall be responsible to return the aforementioned roadway to its original pre-project condition once all materials have been transported for Provincial Highways Project No.6404, and they no longer require use of the roadway

BE IT FURTHER REOLVED that the Interim-Acting CAO shall be authorized to sign the Municipal Haul Road agreement on behalf of the Municipality, a copy of which is attached hereto.

RESOLVED that Council has reviewed the attached Procedures for the Request Forms and Work Orders and shall adopt them for use as part of the Municipality of Swan Valley West Procedures Manual.

RESOLVED that Municipality of Swan Valley West shall apply for a MasterCard in the amount of $15,000.00 under the signing control of the Chief administrative Officer or Reeve for purchases made in accordance with municipal policies and by-laws, and as approved by council when required and;
BE IT FURTHER RESOLVED that an Agline Account in the amount of $15,000.00 shall be authorized under the signing control of the Public Works Foreman for purchases made in accordance with municipal policies and by-laws, and as approved by council when required. Carried:

RESOLVED that the Council for the Municipality of Swan Valley West does hereby approved the following payments:
General Cheques #11371 to #11409 for a total of $146,799.43
Payroll Cheques #174 to #191 for a total of $21,476.64
Council Indemnity Cheques #192 to #201 for a total of $12,546.00
For a Grand Total of $180,802.07

RESOLVED that the Council for the Municipality of Swan Valley West does hereby receive the Bank Reconciliation Report for the Period ending May 31st, 2015, a copy of which is attached hereto.

WHEREAS it is necessary to continue with the operation of the Benito Fire Department under the Village of Benito Policies until such time as the Fire Committee has reviewed said policies and procedures and presents their recommendations for adoption by the Municipality of Swan Valley West;
THEREFORE BE IT RESOLVED that the attached Wage Schedule and List of Fire Fighters shall be approved by Council until such time as a new policy is adopted by the municipality.

RESOLVED that the request from the Benito Fire Department to enter their Rapid Response Unit in the Rodeo Parade and to offer Fire Truck Rides at the Benito Canada Day Celebrations shall be approved by the Council.

RESOLVED that Councillor Potten and Councillor Foster or Councillor Minish shall be approved to travel to Saskatoon and Winnipeg to further investigate the possible purchase of a Tandem Truck and Loader for the Municipality. Carried:

RESOLVED that pursuant to Section 152(3) of the Municipal Act, the Council as a whole shall go into camera and close the meeting to the public to discuss pending legal issues.
