RM of Minitonas – November 12, 2014

Regular Meeting of the members of Council of the Rural Municipality of Minitonas, held in Council Chambers, in Minitonas, Manitoba this 12th day of November, 2014 A.D. at 8:00 am.

WHEREAS Reeve, Michael McIntosh has submitted the attached letter, informing the RM of Minitonas Council that he will not be attending the November & December Meetings of the RM of Minitonas Council, and;
WHEREAS he has also asked not to be paid his November & December, 2014 indemnity payments as a result of his inability to perform the duties of head of council during this time;
THEREFORE BE IT RESOLVED THAT the Council of the RM of Minitonas does hereby agree to withhold the aforementioned payments as requested, and;
BE IT FURTHER RESOLVED THAT Deputy Reeve, Clint Eisner shall assume the position of Acting Reeve in the absence of Reeve, Michael McIntosh and shall assume all duties of the Head of Council, including the position of Chairman for the remaining Council Meetings, until December 31st, 2014.

RESOLVED THAT the Agenda be adopted as presented.

RESOLVED THAT the minutes of the Regular Meeting of Council held October 8th, 2014 and the Special Meeting of Council held on October 16th, 2014 shall be adopted as circulated.

RESOLVED THAT the Financial Statement and Bank Reconciliation for the month ending October 31st, 2014 shall be approved as presented.

WHEREAS the Election of the Council for the Municipality of Minitonas-Bowsman has been held and all documentation relating to the election has been completed;
THEREFORE BE IT RESOLVED THAT we do hereby agree that it is not necessary to wait to make payment in December, 2014 and shall pay out the final quarterly payment for services with the November 12th, 2014 payments.

RESOLVED THAT we do hereby authorize payment of the List of Accounts numbered 9202 to 9293 inclusive, amounting to $1,543,273.91.

WHEREAS the RM of Minitonas Council has received a letter from Prairie Mountain Health requesting a financial contribution of $6,249 toward the redevelopment of the ER & Special Care Unit, as well as the building addition needed to house the MRI Unit, all at the Dauphin Regional Health Centre, and;
WHEREAS the RM of Minitonas will be amalgamating with the Town of Minitonas and the Village of Bowsman on January 1st, 2015 and the current council cannot make any financial decisions that are not included in the 2014 Budget or that will be binding on the future council of the Municipality of Minitonas-Bowsman;
THEREFORE BE IT RESOLVED THAT the aforementioned request shall be forwarded to the new council when they take office on January 1st, 2015.

RESOLVED THAT we do hereby agree to make payment of the attached invoice under the Flood Repair Contract in the amount of $1230.00 and shall include this amount in the 2014 Flood Claim.

WHEREAS the RM of Minitonas has a contract for the purchase of gravel from the owner of the property known as SW ¼ of Section 2-36-25 WPM;
AND WHEREAS the owner wishes to secure funding for 50% of the gravel to be removed by the municipality as prepayment of the stockpile being crushed for use in the 2015 calendar year;
THEREFORE BE IT RESOLVED THAT the Council for the RM of Minitonas does hereby agree to make a payment of $8000 as per the terms of the contract, a copy of which is attached hereto.

10. D. Klekta – E. Rinsdorf
WHEREAS Larry Mychalchuk has been elected as a Councillor for the Municipality of Minitonas-Bowsman, and is a member of the Transition Committee from now until December 31st, 2014 in order to begin planning for the amalgamation of the RM of Minitonas, Town of Minitonas and Village of Bowsman, and;
WHEREAS, in accordance with Subsection 92(7) of The Municipal Act, the attached letter of resignation as a Spare Operator for the RM of Minitonas has been submitted;
THEREFORE BE IT RESOLVED THAT the Council of the RM of Minitonas does hereby accept the aforementioned resignation and offer thanks to Mr. Mychalchuk for his years of service as a spare operator for the municipality.

WHEREAS the Community & Regional Planning Branch has reviewed the application for subdivision of PT of NE ¼ SEC. 14-38-25 WPM (Muller) on behalf of the municipality and finds it to be in compliance with the Zoning By-Law for the RM of Minitonas;
AND WHEREAS there are no objections from any of the government departments or agencies in response to the above noted subdivision;
AND WHEREAS the application has been reviewed by the council of the RM of Minitonas, and found to be acceptable by the members of council;
THEREFORE BE IT RESOLVED THAT the Council of the Rural Municipality of Minitonas does hereby approve the subdivision of the aforementioned parcel of land as per the details submitted to the Municipality by Manitoba Local Government, Community Planning Services dated May 12th, 2014 with the only condition being that the Manitoba Hydro Easement be completed as required and the additional information regarding the existing sewage system be provided to Manitoba Conservation as requested.

WHEREAS the Order No. 14-MO-53-1 was issued pursuant to Section 4 of The Water Rights Act has been received by the Council of the RM of Minitonas for ‘the unauthorized excavation of a drain on land legally described as North of Section 32, Township 37, range 26 WPM’ and;
WHEREAS a fine in the amount of $474.15 was levied by Conservation and Water Stewardship and has been paid by the municipality and remedial works have been completed;
THEREFORE BE IT RESOLVED THAT the CAO shall be authorized to submit a letter to Conservation and Water Stewardship stating that all required remedial works have been completed in accordance with the aforementioned order.

WHEREAS the attached complaint has been received by landowners in the RM of Minitonas regarding the condition of a portion of municipal road on the border of the South Half of Section 1-38-26 wpm;
THEREFORE BE IT RESOLVED THAT the Ward Councillor shall review the status of the area of concern and the CAO shall be authorized to submit a written report to those concerned landowners noted on the attached complaint by November 14th, 2014.

WHEREAS the repairs of Flood Sites Number 5 & 9 within the Rural Municipality of Minitonas as a result of the 2012 Flooding have not yet been completed, and;
WHEREAS the completion of all required engineering studies and reports have not yet been completed, and the tenders for repair work has not yet been advertised;
THEREFORE BE IT RESOLVED THAT the Council of the Rural Municipality of Minitonas does hereby request that the Province of Manitoba – Manitoba Emergency Measures Organization approve an extension to the deadline for the 2012 Flood Repair Claim to December 31st, 2015.

WHEREAS Engineering Studies and Reporting is required in order to determine the most suitable repair design for Site #31-2014, and;
WHEREAS the municipality received notice from Manitoba Emergency Measures Organization that funding for flood damage repairs will be approved under the Disaster Financial Assistance Program as outlined in the attached copy of their letter dated October 16th, 2014;
THEREFORE BE IT RESOLVED THAT the RM of Minitonas Council does hereby agree to hire the services of Stantec Consulting Ltd. for all aspects of the management of the studies, reporting and repairs required for the aforementioned site on behalf of the municipality, and in accordance with the regulations of the Province of Manitoba’s Disaster Financial Assistance Program, and;
BE IT FURTHER RESOLVED THAT the CAO, Carolyn Gordon is hereby authorized to secure the aforementioned management services and order a contract agreement with Stantec Consulting Ltd., understanding that the costs for said services shall be covered under DFA Funding for Site #31-2014.

WHEREAS the Minitonas Lagoon Expansion has been completed to the satisfaction of the RM of Minitonas Council, and;
WHEREAS the application of additional rip rap will be included by Manitoba Water Services Board, and shall include labor of one employee from each of the Town of Minitonas and the RM of Minitonas in order to complete the areas required as noted in the October 9th, 2014 inspection;
THEREFORE BE IT RESOLVED THAT the Council does hereby authorize the CAO to sign the Completion Certificate on behalf of the municipality, a copy of which is attached hereto.

RESOLVED THAT the Council for the RM of Minitonas does hereby agree to sell the cemetery mower as surplus equipment as per the offer attached hereto.

RESOLVED THAT we do now adjourn at 12:25 pm to meet again for the next Regular Meeting of Council on December 22nd, 2014 at 5:30 pm.
