RESOLVED THAT the Agenda be adopted as presented.

2. S. Windsor – D. Bartel
RESOLVED THAT the minutes of the Regular Meeting of the Council of the Town of Minitonas held on July 16th, 2014 shall be adopted as circulated.
Carried.

3. D. Bartel – J. Caruk
WHEREAS effective January 1st, 2015 the Town of Minitonas will be amalgamated with the RM of Minitonas and the Village of Bowsman, operating under a newly amalgamated council, and;
WHEREAS the Minitonas Town Council feels that it is important to continue to advertise and promote Minitonas, ensuring that residents in the Swan River Valley and surrounding area are aware of the local recreation activities and opportunities;
THEREFORE BE IT RESOLVED THAT an ad be placed in the Swan Valley Rec & Leisure Guide as per the revisions attached hereto.

4. J. Caruk – S. Windsor
WHEREAS the attached report was received from the Animal Control Officer regarding a dog bite incident on August 1st , 2014, and;
WHEREAS the Minitonas Town Council has a responsibility under Section 14(2) of the Animal Control By-Law No.5/2002 to hold a public hearing to determine whether the dog is dangerous and to determine the fate of the dog as a result of the aforementioned incident;
THEREFORE BE IT RESOLVED THAT a Public Hearing shall be held on August 20th, 2014 at 7:00 pm for the purpose of allowing the victim and the owner an opportunity to present written statements regarding the aforementioned incident, after which time the Council of the Town of Minitonas shall make a decision regarding the fate of the dog.

5. D. Bartel – S. Windsor
WHEREAS the final debenture payment in the amount of $11,745.91 for the Town Well was levied and included in the 2014 Taxes for the municipality and must be transferred to the Utility Fund for payment, and;
WHEREAS due to clerical error, the aforementioned payment was not included in the ‘Transfer to Utility’ total on page 5 of the Financial Plan and will result in a deficit of the same amount in the General Fund as a result of this error, and;
WHEREAS inclusion of the transfer of the full amount of said debenture payment to the Utility Fund would have resulted in the need to collect an additional amount of $11,745.91 in General Municipal Taxes, borne by all ratepayers of the municipality;
THEREFORE BE IT RESOLVED THAT Manitoba Local Government shall be formally notified of the above noted error;
BE IT FURTHER RESOLVED THAT the full amount of the actual deficit will be determined at yearend 2014 and shall be recovered by ratepayers of the Minitonas Urban Area through General Municipal Taxes for their Service Area in 2015.

WHEREAS the Council of the Town of Minitonas do hereby approve of the transfers of $2286.40 from the joint Fire Fighting Retainer – Captain Equipment Reserve Account to the General Operating Account for the purchase of Major & Miscellaneous Fire Equipment, and;
WHEREAS the withdrawal of funds must also be approved by the Council of the Rural Municipality of Minitonas;
THEREFORE BE IT RESOLVED THAT the aforementioned transfer of funds shall be proposed to the RM of Minitonas Council for approval at their August 13th Council Meeting, and;
BE IT FURTHER RESOLVED THAT once both councils have provided approval of said transfer by resolution, the Mayor & CAO shall be authorized to sign the transfer form and the aforementioned transfer of funds shall be made from the Joint Fire Fighting Retainer- Capital Equipment Account to the Town’s General Chequing Account in the amount of $2286.40.

WHEREAS the Town of Minitonas has received funding under the 2014 Municipal Road Improvement Program for rehabilitation of 275 ft. of 4th Ave. East;
THEREFORE BE IT RESOLVED THAT we do hereby agree to obtain quotes from local construction companies and proceed with the work outlined in the MRIF Grant Applications.

8. J. Caruk – S. Windsor
WHEREAS the Minitonas Town Council has received the attached quote for Munisoft Software, Setup and Training in preparation for the amalgamation of the Town of Minitonas, the Rural Municipality of Minitonas and the Village of Bowsman, and;
WHEREAS the Minitonas Town Council supports the recommendations of the CAO as attached hereto, and understands that the associated costs will be billed to the Municipality of Minitonas-Bowsman after amalgamation in January, 2015;
THEREFORE BE IT RESOLVED THAT the members of the Council of the Town of Minitonas do hereby agree to the submission of the attached quote to Munisoft in order to assist with a smooth transition of the ledger systems during the amalgamation process.

WHEREAS the Minitonas Town Council has reviewed the application made by Robert Falk for a variation of the separation distances from the front site line on the property known as Lots 5 & 6, Block 7, Plan 343, and;
WHEREAS a Public Hearing was held in accordance with Part 6, Section 96 of The Planning Act, and;
WHEREAS the members of the Minitonas Town Council believe that the variance being requested is acceptable and there are no concerns regarding the reduction of the separation distance as proposed on the aforementioned application;
THEREFORE BE IT RESOLVED THAT we do hereby approve Variation Order No. 1/2014 without conditions and authorize the Chief Administrative Officer to sign the Variation Order on behalf of the Municipality.

WHEREAS the Minitonas Town Council has determined that, under the terms of By-Law No. 2/2007, the condition of the attached list of properties has become unsightly, a nuisance and possible danger to the public;
THEREFORE BE IT RESOLVED THAT the owner of the aforementioned properties shall be given written notice advising them that the condition of said property must be rectified by the deadline of August 15th, 2014 and;
BE IT FURTHER RESOLVED THAT, should the condition of the property not be corrected by the aforementioned date, the Minitonas Town Council shall provide authorization for the work to be completed and the associated costs of said work shall be billed to the property owners accordingly.

RESOLVED THAT the Minitonas Town Council has reviewed and approve the adoption of the assessment changes as listed by Manitoba Local Government – Assessment Branch dated July 23rd, 2014 as per the details attached hereto;
BE IT FURTHER RESOLVED THAT the necessary changes shall be made to the 2014 Assessment Roll for the Town of Minitonas under the authority of Subsection 300(6) and Section 326 of The Municipal Act, and Supplementary Tax Bills shall be processed and distributed according to the aforementioned changes.

RESOLVED THAT the Mayor & Council shall sit as a Board of Revision for the 2015 Assessment Rolls for the Town of Minitonas on October 1st, 2014 at 8:00 pm in the Council Chambers as the Minitonas Municipal Office;
BE IT FURTHER RESOLVED THAT all members of council shall be appointed as members of the Board of Revision, that Mayor – Henry Barkowski shall be appointed as the Chairperson, and that CAO – Carolyn Gordon shall be appointed as the Recording Secretary to hear appeals to the real property, personal property and business property assessment rolls for 2015, and;
BE IT FURTHER RESOLVED THAT the deadline for submission of appeals shall be set as 4:30 pm on September 15th, 2014.

RESOLVED THAT new procedures for entering and exiting the Minitonas Fire Hall shall be proposed to the RM & Town of Minitonas Handi-Van Association in order to alleviate concerns over proper lighting and eliminate the risk of setting off the security alarm.

14. S. Windsor – D. Bartel
WHEREAS the Public Works Employee Overtime Reports have been received & reviewed by Council;
THEREFORE BE IT RESOLVED THAT all applicable overtime hours recorded for the month of July, 2014 shall be approved and either paid out with the August 15th, 2014 payroll or booked for future use as indicated on the aforementioned reports, copies of which have been attached hereto.

15. S. Windsor – J. Caruk
WHEREAS people today have the opportunity to live longer because of breakthroughs in medical research, and;
WHEREAS Muscular Dystrophy is a neuromuscular disorder that affects many persons and has no known cure, and;
WHEREAS community support is crucial in finding a cure;
THEREFORE BE IT RESOLVED THAT the Council of the Town of Minitonas does hereby declare September 2014 as ‘Muscular Dystrophy Awareness Month’ in the Town of Minitonas, and;
BE IT FURTHER RESOLVED THAT Mayor Barkowski shall be authorized to make the attached proclamation and sign on behalf of the municipality, and shall affix the corporate seal of the Town of Minitonas on said proclamation.

WHEREAS the Council of the Town of Minitonas feel that it is important to promote Economic Development in the Town of Minitonas throughout the Swan River Valley and outside our local area, and;
WHEREAS the economic development & growth of the Minitonas Urban Area will remain important to the residents and ratepayers after amalgamation in January, 2015;
THEREFORE BE IT RESOLVED THAT we do hereby agree to place the Town of Minitonas in the ValleyBiz Directory for the remainder of 2014 and shall forward a request to the new council of the Municipality of Minitonas-Bowsman for consideration of a directory listing for the 2015 Calendar Year.

WHEREAS the Town of Minitonas Policy – T, Tourism has been reviewed and revised to include Economic Development;
THEREFORE BE IT RESOLVED THAT the Minitonas Town Council does hereby adopt the edits to create Policy Section ‘T’ – Tourism and Economic Development, including a section on Welcoming Newcomers as attached hereto, and;
BE IT FURTHER RESOLVED THAT Kathy Booth shall be appointed as the first ‘Community Welcome Volunteer’ for the Town of Minitonas.

WHEREAS the Council of the Town of Minitonas wishes to recognize families who have made significant contributions to the community and have historical significance in the establishment of the community, and;
WHEREAS Subsection 232(1)(d) of The Municipal Act provides that a council may pass a by-law for municipal purposes respecting municipal roads, including naming the roads and posting the names on public and private property;
THEREFORE BE IT RESOLVED THAT By-Law No. 2/2014, being a By-Law of the Town of Minitonas for the purpose of providing for the naming of all roads in the Town of Minitonas and affixing such names at the corner of each road, shall be introduced and read a first time this 6th day of August, 2014 A.D.

RESOLVED THAT we do now adjourn at 10:25 pm to meet again for the next regular meeting of Council to be held on the 20th day of August, 2014 A.D. at 7:00 pm.
