WHEREAS Merv Werbicki, Werbicki Holding Ltd. has made application to subdivide Lot 1, Plan 22268 being Pt. of SW 1/4 Sec. 16-36-27W into three lots as shown on the attached plot sketch;
AND the subject property is designated AGRICULTURAL AND RURAL DEVELOPMENT AREA according to the Swan Valley Planning District Development Plan and is zoned “AG” Agricultural General according to the R.M. of Swan River Zoning By-Law No. 2383-04;
AND the Development Plan, Section 3.3.4.2 a) b) c) allows for the subdivision of land that has been rendered difficult to farm or has been isolated by way of roads or other features for rural non-farm residential as a permitted use provided they meet the development criteria of the “Rural Residential Development General Provision”;
AND the Zoning By-Law provides for residences as a permitted use within this zone;
NOW THEREFORE BE IT RESOLVED that council in meeting duly assembled hereby approve said subdivision application subject to an approved zoning variation order.

AND the subject property is designated AGRICULTURAL AND RURAL DEVELOPMENT AREA according to the Swan Valley Planning District Development Plan and is zoned “AG” Agricultural General according to the R.M. of Swan River Zoning By-Law No. 2383-04;
AND the Development Plan, Section 3.3.4.2 c) allows for the subdivision of an existing yardsite with residence for a retiring farmer;
AND the Zoning By-Law provides for non-farm rural residences as a permitted use within this zone and the proposed lot conforms to all minimum standards;
NOW THEREFORE BE IT RESOLVED that council in meeting duly assembled hereby approve said subdivision application.
