Town of Minitonas Minutes – November 16, 2011

Regular Meeting of the members of Council of the Town of Minitonas, held in the Council Chambers, Minitonas, Manitoba this 16th day of November, 2011 A.D. at 7:00 p.m.

4.3 Tax Sale – Agreements for Payment

1. W. Robb – D. Bartel
RESOLVED THAT the Agenda be adopted as amended.
Carried.

2. J. Caruk – S. Windsor
WHEREAS the Minitonas Town Council has entered into an agreement for the rent of the Minitonas Marketplace Building;
AND WHEREAS the monthly rental charges and operating costs have been reviewed by council, and it has been determined that they shall remain in effect for the coming year;
THEREFORE BE IT RESOLVED THAT we do hereby propose the attached rental agreement to the tenant for the period from January 1st, 2012 through December 31st, 2012.

3. D. Bartel – J. Caruk
WHEREAS the Minitonas Town Council has entered into an agreement for the rent of the second floor of the Minitonas Library Building;
AND WHEREAS the monthly rental charges and operating costs have been reviewed by council, and it has been determined that they shall remain in effect for the coming year;
THEREFORE BE IT RESOLVED THAT we do hereby propose the attached rental agreement to the tenant for the period from January 1st, 2012 through December 31st, 2012.

4. D. Bartel – W. Robb
WHEREAS the attached tax payment agreement has been received with regards to the property known as Lot 5, Sp. Plan 3061, in the Town of Minitonas (Roll No.1200), and;
WHEREAS the Council has reviewed and approves the content of said agreement as submitted;
THEREFORE BE IT RESOLVED THAT we do agree to accept the Agreement for Payment of Tax Arrears as prepared by Taxervice with regards to the aforementioned property, for payment of the 2009, 2010 and 2011 taxes, penalties and all tax sale costs incurred to date on said property, including any and all costs associated with the preparation of this agreement;
BE IT FURTHER RESOLVED THAT once the aforementioned agreement has been prepared, that the Mayor and Chief Administrative Officer shall be authorized to sign and affix the corporate seal on behalf of the municipality.

5. S. Windsor – D. Bartel
WHEREAS the attached tax payment agreement has been received with regards to the property known as Lot 3, Block 8, Plan 366, in the Town of Minitonas (Roll No. 14000), and;
WHEREAS the Council has reviewed and approves the content of said agreement as submitted;
THEREFORE BE IT RESOLVED THAT we do agree to accept the Agreement for Payment of Tax Arrears as prepared by Taxervice with regards to the aforementioned property, for payment of the 2009, 2010 and 2011 taxes, penalties and all tax sale costs incurred to date on said property, including any and all costs associated with the preparation of this agreement;
BE IT FURTHER RESOLVED THAT once the aforementioned agreement has been prepared, that the Mayor and Chief Administrative Officer shall be authorized to sign and affix the corporate seal on behalf of the municipality.

RESOLVED THAT we do hereby accept the attached quote for repairs on the CAT Loader.
Carried.

7. D. Bartel – S. Windsor
RESOLVED THAT the Minitonas Town Council will make their backhoe available to open the intersection on Main Street and 2nd Avenue when requested by Manitoba Infrastructure & Transportation, and shall submit an invoice for the Town Backhoe cost (including the operator) at the current heavy construction rate.

8. W. Robb– S. Windsor
WHEREAS the Minitonas Town Council has reviewed and is in agreement to the contents of the basic components of the Workplace Health & Safety Policy created by Safety Services Manitoba;
THEREFORE BE IT RESOLVED THAT this policy shall be adopted by the municipality as presented;
BE IT FURTHER RESOLVED THAT specific safe work procedures and additional policies & shall be added as required.

9. J. Caruk – D. Bartel
RESOLVED THAT By-Law No. 5/2011, being a By-Law of the Town of Minitonas to amend By-Law No. 3/2004 which amends Subsection 10.6 regulating the development of land in the municipality, shall be introduced and read a first time this 16th day of November, 2011 A.D.

10. S. Windsor – W. Robb
RESOLVED THAT By-Law No. 6/2011, being a By-Law of the Town of Minitonas to arrange Indemnities for Council, shall be introduced and read a first time this 16th day of November, 2011 A.D.

11. D. Bartel – J. Caruk
RESOLVED THAT By-Law No. 7/2011, being a By-Law of the Town of Minitonas to regulate the proceedings and conduct of Council and the committees thereof, shall be introduced and read a first time this 16th day of November, 2011 A.D.
Carried.

12. D. Bartel – W. Robb
RESOLVED THAT By-Law No. 6/2011, being a By-Law of the Town of Minitonas to arrange the Indemnities for Council, shall be read a second time this 16th day of November, 2011 A.D.
Carried.

13. S. Windsor – W. Robb
RESOLVED THAT By-Law No. 7/2011, being a By-Law of the Town of Minitonas to regulate the proceedings and conduct of Council, shall be read a second time this 16th day of November, 2011 A.D.
Carried.

RESOLVED THAT we do now adjourn at 11:05 pm to meet again on December 7th, 2011 at 7:00 pm for the next Regular Meeting of Council.
