Minutes of the Regular Meeting of Council of the Rural Municipality of Mountain held Wednesday, October 11th, 2023 at the Rural Municipality of Mountain Council Chambers in Birch River, MB.


Members Present:

CAO Paige Wozny was present and acted as secretary.
Finance Officer Kim Paterson was also present.

1. Call to Order

The meeting was called to order at 10:00 a.m. by Reeve Keith Behrmann, quorum being present.

THEREFORE BE IT RESOLVED THAT Council of the Rural Municipality of Mountain hereby allow the consideration of the application and approve the Snowplow Account for the NW 9-34-20W, upon receipt of payment.

10.1 Property Cleanup: Issue Formal RFP

10.1.1 Fire Department Response: Property Cleanup Order

WHEREAS the Mountain North Fire Department attended multiple suspicious fires located at 117 4th Street and 118 4th Street, Birch River on October 5th, 2023, both of which were unpermitted and subject to outstanding Property Cleanup Orders;
THEREFORE BE IT RESOLVED THAT Council of the Rural Municipality of Mountain hereby issue fine under the Fire Prevention and Emergency Serivces By-Law No. 05/21 to the property owner in the amount of:
First Contravention Fine: $250.00
Fire Department Response to First Contravention: $500.00
Additonal costs to the Municipality, including:
Fire Department Member wages
Large equipment rental

10.2 Unlicensed Apiary: Cowan

BE IT RESOLVED THAT Council of the Rural Municipality of Mountain have been made aware of an unlicensed and unpermitted apiary within the townsite of Cowan;
AND WHEREAS the Animal Control By-Law provides that livestock should not be kept in urban areas if such livestock would adversely affect residents, and there have been complaints raised in regards to this operation;
THEREFORE BE IT RESOLVED that Council of the Rural Municipality of Mountain hereby determine that this apairy operation located on Lot 4, Plan 1675 be deemed as adversely affecting residents and shall cease immediately;
AND FURTHER BE IT RESOLVED fines be issued under Animal Control By-Law No. 06/21 and such fines be doubled as a seperate offence following non-compliance after each 7 day period;
AND THAT THE CAO be authorized to issue fines and sign on behalf of the Municipality under this resolution.

BE IT RESOLVED THAT Council of the Rural Municipality of Mountain hereby accept the offer to purchase of Lots 1-4, Block 1, Plan 121; in Pine River, MB [Roll#59400.000, 59500.000 & 59600.000] from C. Semchyshyn in the amount of the reserve bid plus any legal or transfer costs;
AND THAT the transfer be subject to the following conditions:
The Rural Municipality of Mountain is under no obligation to provide access to such parcels, now or upon future request;
The parcel is sold in the as is where is condition.

10.4 Woody River Log Jam: SLWD Project

WHEREAS the Province has tentitively annouced funding for the Woody River Log Jam project which is being managed by the Swan Lake Watershed District;
THEREFORE BE IT RESOLVED THAT Council of the Rural Municipality of Mountain hereby approve funding to a maximum of $2,000.00 towards the project pending the approval of funds from:
The Province of Manitoba; and
Adjacent landowners

11.2 2023 DFA Claim: Deadline Extension

WHEREAS the 2022 DFA Flood Claim deadline for submissions is November 15th, 2023;
AND THEREFORE there are still approximately 5 outstanding sites to be completed due to availablity of contractors to complete work prior to the deadline;
THEREFORE BE IT RESOLVED THAT Council of the Rural Municipality of Mountain hereby request the Disaster Financial Assistance program be extended for Claim Number 200204177 to June 30th, 2024.
