Minutes of the Regular Meeting of Council of the Rural Municipality of Mountain held Wednesday, March 27th in the R.M. of Mountain Council Chambers in Birch River, Manitoba.

CAO Paige Larocque was present and acted as secretary.
Finance Officer Kim Paterson was also present.

1. Call to Order

The meeting was called to order at 10:00 a.m. by Reeve Robert Hanson, quorum being present.

WHEREAS the Traffic and Transportation Modernizaton Act, which came into effect on March 1, 2019, makes Manitoba Infrastructure responsible for setting speed limits on all provincial roads;
AND WHEREAS the Rural Municipality of Mountain hereby request Manitoba Infrastructure to alter the following speed limits within the RM of Mountain:
All roads under Manitoba Infrastructure within the LUD of Birch River speed limit of 70 km/h to 50 km/h.

9.7 June District Resolution – Tax Sale

WHEREAS Regulation Number 50/97 is a regulation under The Municipal Act which prescribes fees, discounts and penalties which municipalities may provide or charge their ratepayers;
AND WHEREAS this Regulation sets the maximum fee for the administration of Tax Sale, being $50.00;
AND WHEREAS this fee is no longer an accurate reflection of the work and costs bore by the municipality in administering a Tax Sale;
THEREFORE BE IT RESOLVED THAT the AMM lobby the Province of Manitoba to update Regulation 50/97 under The Municipal Act to provide for an administration fee for tax sales that is suitable to the costs and work involved in administering a Tax Sale.

9.7.1 June District Resolutions – Tax Sale

WHEREAS there is no penalty to any land owners for allowing their property to be sold through a Municipal Tax Sale;
AND WHEREAS municipalities are burdened with tax sale costs, property cleanup and ongoing maintenance after these properties go through the Tax Sale;
AND WHEREAS if a property owners credit score was affected by letting these parcels of land go through the Tax Sale it would deter many from giving up certian lands and decrease the amount of costs bore by the municipality;
THEREFORE BE IT RESOLVED THAT the AMM lobby the Province of Manitoba to make adjustments to The Municipal Act, specifically Division 6 in regards to Tax Sales of Real Property to make provision that those persons who allow their property to be sold at a Municipal Tax Sale will have such registered against their credit score.

9.8 June District Resolution – LGD Vested Crown Lands

WHEREAS former Local Government District’s had entered into administrative agreements with the Province of Manitoba to administer certian parcels of land in their behalf;
AND WHEREAS at any point in time the Municipality may request that certian parcels be returned to the Municipality;
AND WHEREAS if the Municipality were to make such a request, it involves wait times up to several years, legal surveying, and complicated administration procedures;
THEREFORE BE IT RESOLVED THAT the AMM lobby the Province of Manitoba to further reduce red tape and no longer require municipalities to complete legal surveys in order to obtain title back for these LGD Vested-Crown Administered Lands as well as reduce wait times and expediate the process for title transfer for these specifc properties.
