RM of Mountain Minutes – December 28, 2017

Minutes of the Regular Council Meeting of the Rural Municipality of Mountain held Thursday December 28th, in the R.M. of Mountain Council Chambers in Birch River, Manitoba.

The meeting was called to order at 10:10 A.M. by Reeve Marvin Kovachik, quorum being present.

BE IT RESOLVED THAT the Agenda for the December 28th, 2017 Regular Meeting of Council be adopted as amended.

BE IT RESOLVED THAT the Minutes of the Animal Control Hearing held December 13th, 2017 be adopted as presented, all requirements having been complied with.

BE IT RESOLVED THAT the Minutes of the regular meeting of Council held December 13th, 2017 be adopted as presented, all requirements having been complied with.

WHEREAS The Emergency Measures Act requires communities to have Emergency Preparedness programs;
AND WHEREAS the Municipal Emergency Coordinator has presented an updated Emergency Preparedness Plan for approval;
THEREFORE BE IT RESOLVED THAT Council of the Rural Municipality of Mountain hereby accept the Emergency Preparedness Plan as presented;
AND THAT the Emergency Plan be submitted to Emergency Measures Organization for approval.

BE IT RESOLVED THAT By-Law No. 08/17, being the By-Law to establish a solid waste management system within the Rural Municipality of Mountain, be introduced and given first reading.

THEREFORE BE IT RESOLVED THAT the unpaid utility accounts, presented in Schedule ‘A’ attached hereto, be added to the real property tax account of each account holder.

WHEREAS Section 152(3) of The Municipal Act authorizes Council to close a meeting to the public to discuss certain matters;
AND WHEREAS Section 15.13 of By-Law #01/11, The Procedures By-Law of The Rural Municipality of Mountain, instructs a member to;
“…keep in confidence a matter that is discussed at a meeting closed
to the public under subsection 152(3) of The Act until the matter is
discussed at a council meeting conducted in public.”
BE IT RESOLVED THAT Council of the Rural Municipality of Mountain meet as a committee to discuss legal matters.

BE IT RESOLVED THAT the meeting of the committee of the whole be adjourned, and that the regular meeting of Council of the Rural Municipality of Mountain be re-opened to the public.

Councillor Nadolney presented a Notice of Motion to reconsider Res. No. 350/17 at the next regular council meeting.
WHEREAS Fire Department Purchasing Policy states that all purchases of the Fire Department must be authorized by Council in advance;
THEREFORE BE IT RESOLVED THAT Council of the Rural Municipality of Mountain approve the purchase requests as per Schedule ‘A’ attached hereto.

Councillor Forbes Declared an interest for Res. No. 466/17 and left the meeting

RESOLVED THAT Cheque Nos. 20171570 to 20171634 be approved for payment in the amount of $57,369.72, including 6,359.19 for Council Indemnities, as per By-Law 03/16, and Direct Deposit Payroll in the amount of 7,242.09 as attached hereto as Schedule A.

BE IT RESOLVED THAT the Rural Municipality of Mountain hereby adopt the following 2018 Interim Operating Budget as per Section 163 of the Municipal Act to allow for expenditures:

WHEREAS Council of the Rural Municipality of Mountain held a public hearing December 28th, 2017 regarding Breach of By-Law 02/06 Animal Control for M. Burmaster;
AND WHEREAS
there was no representations/no objections;
THEREFORE BE IT RESOLVED THAT
Council vary the charges as follows:
pay 2018 licences by January 21, 2018 otherwise fine $50.00 plus
licences will be enforced.

WHEREAS Council of the Rural Municipality of Mountain held a public hearing December 28th, 2017 regarding Breach of By-Law 02/06 Animal Control for G. Marks;
AND WHEREAS
there was no representations/no objections;
THEREFORE BE IT RESOLVED THAT
Council vary the charges as follows:
fine be waived conditional to not possessing dogs for 5 years

BE IT RESOLVED THAT Municipal Emergency Coordinator Stephen Nadolney of the Rural Municipality of Mountain hereby be authorized to attend the 2018 Municipal Emergency Workshop in Dauphin, MB on January 23rd, 2018;
AND THAT expenses be allowed for same.

WHEREAS Manitoba Hydro requires a resolution of council for quotations concerning new streetlights;
AND WHEREAS the Ward 6 Councillor would like to install a new streetlight near the Mafeking Waste Transfer Station;
THEREFORE BE IT RESOLVED THAT Council of the Rural Municipality of Mountain apply to Manitoba Hydro for a quotation for a streetlight as per Schedule ‘A’ attached hereto.

WHEREAS Section 8.6 of By-Law No. 01/16 allows Council to extend the time of adjournment after curfew by one half hour;
THEREFORE BE IT RESOLVED THAT the Regular Meeting of Council of the Rural Municipality of Mountain be extended to 5:00 pm.

BE IT RESOLVED THAT Council of the Rural Municipality of Mountain hereby approve the wage schedule as outlined in Schedule ‘A’ attached hereto, effective January 1st, 2018.
