Regular Meeting of the Council of the Municipality of Swan Valley West, held in the Council Chambers at 216 Main Street West, Swan River, Manitoba this 30th day of March, 2017 at 7:00 p.m.


Reeve Scouten Welcomed New Council Member, Irwin Steen.
CAO, Carolyn Gordon confirmed that the Oath of Office was taken by Councillor Steen and witnessed by herself and Finance Officer, Angela Mullin.

RESOLVED that, in accordance with Subsection 162(2) of the Municipal Act, Public Hearings shall be held on April 18th, 2017 and April 19th, 2017 as follows;

April 19th, 2017 at the Municipal Office in Swan River at 7:00 pm
AND BE IT FURTHER RESOLVED that notices shall be placed in the Swan River Office, Benito Satellite Office, in the local newspaper and on the municipal website.

RESOLVED that we do hereby agree to purchase Magnesium Chloride from Fort Distributors Ltd. for 2017 Dust Control at the same price as paid in 2016;
$.32/litre (price to include supply & application)
AND BE IT FURTHER RESOLVED that the cost for Private dust control Application shall remain the same as the rate set in 2016;
$420.00 per application of 500 ft. x 16 ft.

RESOLVED that the members of Council for the Municipality of Swan Valley West do hereby approve payment of the Swan Valley District Recreation Levy in the amount of $18,359.00 for the 2017 Fiscal Year.

RESOLVED that the members of Council for the Municipality of Swan Valley West do hereby approve payment of the Swan Valley Planning District Levy in the amount of $5,425.00 for the 2017 Fiscal Year.

WHEREAS the owners of PT. NW ¼ SEC. 10-37-27W have made application to subdivide their property, and;
WHEREAS the Council for the Municipality of Swan Valley West has reviewed said application, along with the letter received from Indigenous and Municipal Relations dated March 22nd, 2017 and have no objections to the aforementioned subdivision;
THEREFORE BE IT RESOLVED we do hereby approve the subdivision of the aforementioned property, provided all conditions and requirements are met as included with the above noted letter.

WHEREAS the Council for the Municipality of Swan Valley West has received an application for a Conditional Use Permit on the property known as the NW ¼ Section 7-37-27W, specifically to allow for the operation of Kennel in an AG – Agriculture General Zone, as per Table 4-1 of Zoning By-Law #2383-04, and;
WHEREAS a Public Hearing was held on February 13th, 2017 in accordance with Part 6 of the Planning Act and has not received any objections with respect to the operation of a kennel in this area;
THEREFORE BE IT RESOLVED that Council of the Municipality of Swan Valley West does hereby approve the aforementioned application and shall issue Conditional Use Order No.2017-02;
BE IT FURTHER RESOLVED that the Reeve and CAO shall be authorized to sign said Order on behalf of the Municipality.

RESOLVED that the attendance of the Emergency Coordinator at the 2017 Disaster Management Conference to held in Winnipeg, MB. On May 31st, 2017 to June 2nd, 2017 shall be approved and all applicable expenses shall be paid by the Municipality in accordance with current Municipal Policies and By-Laws.

***With reference to the March 30th, 2017 Agenda, Item # 5.11, Resolution #14 regarding Aggregate Levies – Mining & Transport Councillor Foster, member of council for the Municipality of Swan Valley West, disclosed a personal interest in the matter before council.***

RESOLVED that, in accordance with By-Law No.0053-17 and Regulation No.48/97 of the Municipal Act, the rates for Aggregate Fees for the 2017 Fiscal Year shall be set by the Council for the Municipality of Swan Valley West as follows;
Aggregate Mining Fee of $.20 per cubic yard
Aggregate Transport Fee of $.25 per cubic yard

WHEREAS the Council for the Municipality of Swan Valley West received and reviewed the letter from Keystone Agriculture Producers regarding concerns for recent increases in the municipal taxes experienced by agriculture producers as a result of the 2016 assessment values on farmland increasing at a far higher rate than other property classes, and;
WHEREAS the members of Council took this assessment shift into consideration when setting the taxes for 2016 and will continue to make careful consideration of this situation going forward;
THEREFORE BE IT RESOLVED that we do hereby agree to explore possible solutions to provide fairness of taxation and tax sharing by all assessment classes.

WHEREAS National Public Works Week has been set for the week of May 21st – 27th, 2017 and;
WHEREAS the members of Council agree that it is important to recognize Municipal Public Works Management and Staff for their valuable contribution to work they perform for the benefit of the ratepayers and residents of the Municipality;
THEREFORE BE IT RESOLVED that we do hereby agree to declare the week of May 21st – 27th, 2017 as “Public Works Week” in the Municipality of Swan Valley West.

WHEREAS the Council for the Municipality of Swan Valley West agrees that the establishment of an MRI Facility at the Dauphin Regional Health Centre would provide a significant benefit to their residents who may one day require such specialized services for which they are currently required to travel great distances;
THEREFORE BE IT RESOLVED that we do hereby support the letter drafted by the RM of Dauphin and authorize Reeve Scouten to sign said letter on behalf of the Municipality.

WHEREAS the members of the Council for the Municipality of Swan Valley West believe that important services are provided by FCM through their Legal Defense Fund;
THEREFORE BE IT RESOLVED that we do hereby agree send a financial contribution in the amount of $70.59 toward the aforementioned fund.
