RESOLVED that the Council for the Municipality of Swan Valley West has reviewed the application and engineer’s report regarding the Swan Lake Watershed Conservation District Drainage Project on the East ½ of Section 19-35-27 WPM and have no concerns at this time.

RESOLVED the Council for the Municipality of Swan Valley West does hereby agree to provide Municipal Landowner Approval for the Applications for License to Construct Water Control Works on the following property where said works cause surface water to enter into the municipal ditches, as indicated on the maps submitted with said applications to the Province of Manitoba;

– SE ¼ 31-36-27WPM & NE ¼ 30-36-27WPM
– SE ¼ 32-36-27WPM

– Minor Works Application Prepared on Behalf of the Municipality dated July 26th, 2016
AND BE IT FURTHER RESOLVED that all drainage works shall conform with the terms and conditions set by the Province of Manitoba, and any works outside of those shown on the aforementioned application shall be identified and brought to council for approval of additional drainage into the municipal ditch prior to commencing construction of the same, and;
BE IT FURTHER RESOLVED that either the Reeve or the CAO shall be authorized to sign the Landowner Approval Sections of the Provincial Applications to Construct Water Control Works and the Municipal Landowner Agreement & Liability Release Form (where applicable) on behalf of the Municipality.

RESOLVED that the Council for the Municipality of Swan Valley West shall hereby approve the construction of an approach to the property known as the SW ¼ 21-34- 29WPM as per the terms and conditions noted on the Landowner Agreement & Liability Release Form dated this 26th day of July, 2016.

WHEREAS the members of council, together with the CAO and Superintendent of Public Works have reviewed and approve the list of capital projects for 2016, and funding for the projects has been included in the 2016 Financial Plan for the municipality,
THEREFORE BE IT RESOLVED that we do hereby agree to submit an application for the list of road projects and the bridge project as included in the report dated July 22nd, 2016 and shall authorize either the CAO or the Finance Clerk to submit said application on behalf of the Municipality of Swan Valley West.

WHEREAS the Council for the Municipality of Swan Valley West has retained the services of Stantec Consulting Inc. to manage all aspects of the works required to complete the necessary repairs to rebuild the crossing at Flood Site #65/2014 under the terms and conditions set out in the Disaster Financial Assistance Program and as required under Federal and Provincial Laws, and;
WHEREAS a recommendation has been received from Stantec regarding the preferred contractor for the Flood-Site #65/2014 Repair Project;
THEREFORE BE IT RESOLVED that the contract for the re-construction of the crossing at Site #65/2014 – Project No. 113732520 to Minty’s Moving Ltd.

WHEREAS the Municipality of Swan Valley West has received several applications under FIPPA that require approval of council;
THEREFORE BE IT RESOLVED that we do hereby approve the handling of said requests by the CAO and the Finance Clerk in accordance with the Freedom of Information and Public Privacy Act and that quotes for services and notification of time extensions shall be issued to the applicant as required, and as instructed by council.

RESOLVED that attendance at educational seminars shall be approved as follows;
– CAO re: FIPPA Information Management Conference being held on September 27th & 28th, 2016 in Winnipeg, MB.
– Finance Clerk re: Municipal Capital Assets Course being held on September 9th, 2016 in Brandon, MB.
AND BE IT FURTHER RESOLVED that all expenses related to the attendance of said employees as noted above shall be paid by the municipality in accordance with the current municipal policies and by-laws.

RESOLVED that in accordance with Sections 300 and 326 of the Municipal Act, the changes to the 2016 Assessment Roll for the Municipality of Swan Valley West shall be accepted by the Council and applied to that portion of the 2016 taxes as described on the reports received from the Province of Manitoba – Assessment Services, Swan River Office dated July 18th, 2016, copies of which are attached hereto.

RESOLVED that, in accordance with Subsections 41(2) and 41(3) of the Municipal Assessment Act, the attached Ad for the Board of Revision for the 2017 Assessment Roll will be;
– printed in the Star & Times on October 4th, 2016 and October 18th, 2016
– posted in the Municipal Offices at 216 Main Street West, Swan River, MB.
– posted in the Satellite Office at 126 Main Street, Benito, MB.
AND BE IT FURTHER RESOLVED that the deadline to submit applications for revision of 2017 Assessments shall be set as October 25th, 2016.

RESOLVED that the Board of Revision for the 2017 Assessment Roll will be set for Tuesday, November 8th, 2016 at 7:00 p.m. in the Council Chambers of the Municipality of Swan Valley West, 216 Main Street West, Swan River, MB. and;
BE IT FURTHER RESOLVED that the Members of Council shall sit as a Board for the purpose of hearing applications for revision of assessments under Subsection 42(1) of the Municipal Assessment Act, with the Reeve to sit as the Chairman of the Board and the Chief Administrative Officer to sit as the Secretary of the Board.

WHEREAS the purchase of a semi & belly-dump would benefit the municipality by reducing costs and providing efficient/timely road maintenance and were included in the 2016 Financial Plan;
THEREFORE BE IT RESOLVED that we do hereby agree to move forward with the purchase of said equipment that will meet the specifications, budget, and a personal inspection, and;
BE IT FURTHER RESOLVED that the Superintendent of Public Works, along with a member of council, shall be authorized to locate such equipment, perform a personal inspection and bring a recommendation to a Special Meeting of Council, which shall be called with 24 hours notice for the purpose of approving a recommendation to purchase from the Superintendent,

RESOLVED that the Benito Landfill Site Inspection Report dated June 22nd, 2016 / July 4th, 2016 shall be received by the Council for the Municipality of Swan Valley West.

WHEREAS the Municipality of Swan Valley West has received an email notification from Kim Pierce of Benito Premium Meats dated July 16th, 2016 that they will no longer be using the Benito Waste Disposal Site for disposal of their offal,
THEREFORE BE IT RESOLVED that the Council for the Municipality of Swan Valley West shall hereby authorize the CAO to cancel the agreement for the acceptance of offal, previously approved on July 12th, 2016 and to close the file as there is no longer a need for offal disposal services according to the aforementioned email instructions.

WHEREAS the New CGIS Mapping Program is now active and the budget set by the Council for 2016 has sufficient funds remaining for additional programming,
THEREFORE BE IT RESOLVED that the Council for the Municipality of Swan Valley West shall hereby accept the recommendation of the CAO to order enhancements to the CGIS Program dated July 25th, 2016.

RESOLVED that the Council for the Municipality of Swan Valley shall receive the Financial Report from the Kenville Memorial Hall for the period ending March 31st, 2016 and;
BE IT FURTHER RESOLVED that we shall hereby authorize payment of the $1000 Kenville Community Hall Grant as included in the 2016 Financial Plan.

WHEREAS Section 372 of The Municipal Act provides the municipality with the ability to set a reserve bid for any property being sold at the Tax Sale Auction;
THEREFORE BE IT RESOLVED that the Council for the Municipality of Swan Valley West shall hereby set a reserve bid equal to the amount of tax arrears, including all accumulated interest, and costs owing for any property being sold at the Tax Sale Auction to be held on October 13th, 2016 at 10:00 am in the Council Chambers, 216 Main Street West, Swan River, MB. and;
BE IT FURTHER RESOLVED that we do hereby appoint the CAO to bid on behalf of the Municipality.

RESOLVED that we do hereby confirm the appointment of BMP Chartered Accountants as the Municipal Audit Firm for Swan Valley West for the 2016 Fiscal Year.

RESOLVED that, in accordance with Clause 8.5 of By-Law No. 0002-15, the council shall extend the curfew by up to one-half hour in order to complete discussions regarding the remaining items on the agenda requiring a resolution of council.

WHEREAS the Council for the Municipality of Swan Valley West has determined that edits were required to the Media Policies to allow for the appointment of the Media Spokesperson by Resolution of Council;
THEREFORE BE IT RESOLVED that we do hereby approve the edits to the Media Relations Policy for both the members of council and the employees as presented.

WHEREAS surplus property has been held by the municipality for several years, pending offers to purchase from the general public, and;
WHEREAS a written offer to purchase the property known as 17, Block 6, Plan 164 – 57, 2nd Avenue West, Benito, MB. has been submitted to the Council for the Municipality of Swan Valley West;
THEREFORE BE IT RESOLVED that we do hereby agree to accept the offer submitted by Cale Macooh to purchase the above noted property under the terms and conditions of the agreement attached hereto.

General Cheques #12572 to #12603 in the amount of $103,556.95

WHEREAS the municipality requires an Interim Building Inspector, and the CAO has met with the Inspector for the Town of Swan River, who has agreed to provide interim services until such time as the process of advertising, interviewing and selection of the appropriate candidate can be completed;
THEREFORE BE IT RESOLVED that we do hereby agree to accept the recommendation submitted by the CAO dated July 25th, 2016, and;
BE IT FURTHER RESOLVED that the attached ad shall be placed in the Star & Times on August 9th, 2016 and August 16th, 2016 and on ValleyBiz August 9th to 15th, 2016 as well as on the Municipality’s Website, with a deadline for applications to be set for August 18th, 2016 at Noon and interviews to be held on or before August 19th, 2016.
