Town of Mintonas Minutes – December 17, 2014

Regular Meeting of the members of Council of the Town of Minitonas, held in the Council Chambers, Minitonas, Manitoba this 17th day of December, 2014 A.D. at 7:00 p.m.

1. S. Windsor – D. Bartel
RESOLVED THAT the Agenda be adopted as presented.
Carried.

2. S. Windsor – J. Caruk
RESOLVED THAT the minutes of the Regular Meetings of the Council of the Town of Minitonas held on November 5th, 2014 and November 19th, 2014 shall be adopted as circulated.
Carried.

3. J. Caruk – D. Bartel
RESOLVED THAT the Bank Reconciliation for the period ending November 30th, 2014 and Financial Statement for the period ending December 17th, 2014 shall be approved as presented.
Carried.

4. S. Windsor – D. Bartel
RESOLVED THAT the Animal Control Officer’s Report for the month of November, 2014 shall be accepted as presented, a copy of which is attached hereto, and:
BE IT FURTHER RESOLVED THAT payment for contract services for Animal Control shall be made as per the aforementioned report.

5. J. Caruk – D. Bartel
RESOLVED THAT approval of payment be made for the List of Accounts numbered 6249 to 6310 inclusive, amounting to $72,694.11

6. S. Windsor – J. Caruk
RESOLVED THAT the Council of the Town of Minitonas do hereby authorize the Transfers from the Municipality’s General Operating Accounts to the Reserve Accounts as per Schedule ‘A’ attached hereto.

7. D. Bartel – J. Caruk
WHEREAS the Council of the Town of Minitonas do hereby approve of the purchase and transfer of $680 plus taxes and installation costs from the joint Fire Fighting Retainer – Capital Equipment Reserve Account to the General Operating Account for the purchase of a new computer system for the fire department, and;
WHEREAS the withdrawal of funds must also be approved by the Council of the Rural Municipality of Minitonas;
THEREFORE BE IT RESOLVED THAT the aforementioned transfer of funds shall be proposed to the RM of Minitonas Council for approval at their December 22nd, 2014 Council Meeting, and;
BE IT FURTHER RESOLVED THAT once both council have provided approval of said transfer by resolution, the Mayor & CAO shall be authorized to sign on behalf of the municipality and the aforementioned funds shall then be moved from the joint Fire Fighting Retainer – Capital Equipment Reserve Account to the Town’s General Chequing Account.

8. S. Windsor – D. Bartel
WHEREAS Resolution No. 5 dated November 19th, 2014 approved payment of works for the completion of the rip-rap, drainage and landscaping at the Minitonas Lagoon Site;
AND WHEREAS only a portion of the works have been completed, with the remainder to be finished in 2015;
THEREFORE BE IT RESOLVED THAT the amount of $2370 shall be paid in 2014 as noted on Invoice #Lagoon-2014 dated November 16th, 2014 and the remainder of said invoice shall be held for payment once the work has been completed in 2015 and the exact number of hours has been determined, and;
BE IT FURTHER RESOLVED THAT Invoice #TOWN-4-2014 shall be held for completion of works in 2015 and Invoice #WCB 1-2014 shall be amended to reflect the above noted changed and additional costs as attached hereto.

9. J. Caruk – S. Windsor
WHEREAS all properties with taxes owing for any portion of the year 2012 or prior, along with the associated tax sale cost have been paid in full, and;
WHEREAS Taxervice has submitted a final report indicating that there are no unpaid for 2013 and the tax sale auction has been cancelled.
THEREFORE BE IT RESOLVED THAT we do hereby accept the aforementioned report, a copy of which is attached hereto, and close the 2014 Tax Sale.

10. S. Windsor – D. Bartel
WHEREAS enhancement and support of local business is extremely important to the appearance and promotion of local economic development;
THEREFORE BE IT RESOLVED THAT Minitonas Town Council approves the attached letter of support for applications to the Hometown Manitoba – Main Street Enhancement Program by local business owners.

11. J. Caruk – D. Bartel
WHEREAS under the authority of Subsection 252(2) of The Municipal Act, a municipality may collect unpaid fees and utilities in the same manner as a tax may be collected and enforced;
AND WHEREAS the municipality has received no payments to date for any of the amounts listed on the attached report, and said amounts remain outstanding as of today’s date;
THEREFORE BE IT RESOLVED THAT the amount of debt owing to the Town of Minitonas for unpaid utility accounts and unpaid maintenance costs listed on Schedule ‘A’ attached hereto shall be moved to the property taxes for the associated properties effective December 31st, 2014, and;
BE IT FURTHER RESOLVED THAT notice shall be sent to the property owners detailing the amounts being added to the taxes, and the interest will accrue on said debt in the same manner as unpaid taxes effective Jan 1st, 2015.

12. S. Windsor – J. Caruk
WHEREAS the attached letter has been received from Betty MacCumber providing notification that she will no longer be cleaning the Library effective December 31st, 2014, and;
WHEREAS written notice has been received from Nadia Olson, our current librarian, that she is interested in assuming the cleaning duties at the Minitonas Library;
THEREFORE BE IT RESOLVED THAT Minitonas Town Council accepts Betty’s notice of retirement from her cleaning duties and agrees to forward the attached letter from Nadia to the Council for the Municipality of Minitonas-Bowsman along with a recommendation to accept her offer to enter into a contract service agreement for cleaning the Minitonas Library.

13. D. Bartel – S. Windsor
WHEREAS the attached letter has been received letter from Kevin & Michelle Stanick providing the Town of Minitonas with written notice of their intent to terminate their rental agreement effective December 31st, 2014 and;
WHEREAS such written notice has been provided in accordance with said agreement;
THEREFORE BE IT RESOLVED THAT Minitonas Town Council accepts the notice to terminate as provided by Kevin & Michelle Stanick and do hereby terminate said agreement effective December 31st, 2014 and that no further payments will be issued once the 2014 rent has been paid in full.

14. S. Windsor – D. Bartel
RESOLVED THAT the Public Works Report for the month of November, 2014 shall be accepted as submitted by the Town Foreman, a copy of which is attached hereto.
Carried.

15. J. Caruk – S. Windsor
WHEREAS the Public Works Employee Overtime Reports have been received & reviewed by Council;
THEREFORE BE IT RESOLVED THAT all applicable overtime hours recorded for the month of November, 2014 shall be approved and banked for future use as indicated on the aforementioned reports, copies of which have been attached hereto.

16. S. Windsor – D. Bartel
WHEREAS the deficit application approved by the Public Utilities Board for the 2011 Utility Deficit did not include PSAB adjustments and;
WHEREAS there is no deficit for 2013 according to PUB Schedule 9 but there is now a deficit for 2012;
THEREFORE BE IT RESOLVED THAT the Minitonas Town Council does hereby agree to submit applications to the Public Utility Board for approval of a deficit in the amount of $13,504 for 2011 and a deficit in the amount of $9,035 for 2012, and;
BE IT FURTHER RESOLVED THAT a request be submitted to the Public Utilities Board along with the deficit application to approve a ‘Rate Rider’ in the amount of $12.50 per Utility Bill for the next two years (8 billing periods) I order to collect a cash deficit in the amount of $22,500 while a Rate Study is being undertaken and an increase in rates is being explored.

RESOLVED THAT the attached letter of resignation received from Brandie McDuff shall be accepted with regrets and best wishes for success in her new career.

18. S. Windsor – D. Bartel
RESOLVED THAT we do now adjourn at 9:25 p.m. with no further meetings to be held due to the amalgamation with the Village of Bowsman and the RM of Minitonas, this being the final regular meeting of the Town of Minitonas, and;
BE IT FURTHER RESOLVED THAT should there be any matters that require a decision of the Minitonas Town Council before December 31st, 2014 we do agree to hold a Special Meeting of Council to deal with such matters accordingly.
