RM of Minitonas Minutes – March 26, 2014

Regular Meeting of the members of Council of the Rural Municipality of Minitonas, held in Council Chambers, in Minitonas, Manitoba this 26th day of March, 2014 A.D. at 7:00 pm.

1. W. Pacamaniuk – C. Eisner
RESOLVED THAT the Agenda be adopted as presented.
Carried.

2. D. Klekta– E. Rinsdorf
RESOLVED THAT the Council of the Rural Municipality of Minitonas have reviewed and approve the attached gravel contracts for the 2014 Fiscal Year, and;
BE IT FURTHER RESOLVED THAT the Reeve & CAO are hereby authorized to sign said agreements on behalf of the municipality,

3. W. Pacamaniuk – C. Eisner
WHEREAS the RM of Minitonas Council has reviewed the excavator rental proposals submitted;
THEREFORE BE IT RESOLVED THAT the Council agrees to rent a 2014 Deere 210G LC Excavator as per the proposal attached hereto, and;
BE IT FURTHER RESOLVED THAT the Reeve & CAO are hereby authorized to sign said rental agreement on behalf of the municipality.

4. E. Rinsdorf – D. Klekta
WHEREAS the RM of Minitonas Council has met with representatives from Manitoba Hydro and discussed the need to re-establish a section of hydro lines and poles along NE 07-35-26WPM;
AND WHEREAS the undermining of the poles and need to replace or re-set poles is a direct result of the July, 2012 flooding at sites #54, #76 & #104;
THEREFORE BE IT RESOLVED THAT the Reeve & CAO are hereby authorized to sign said service agreement on behalf of the municipality, and;
BE IT FURTHER RESOLVED THAT the plans and letter of explanation from Manitoba Hydro shall be submitted to the Manitoba Emergency Measures Organization for consideration of funding of the municipal portion under their 2013 Disaster Financial Assistance Claim.

5. W. Pacamaniuk – E. Rinsdorf
RESOLVED THAT we do hereby agree to the attached contract agreement for Mini-Hoe Rental for 2014.
Carried.

6. C. Eisner – D. Klekta
WHEREAS the RM of Minitonas Council has reviewed and approve the attached contract agreement for the 2014 Fiscal Year;
THEREFORE BE IT RESOLVED THAT Howard Graham shall be hired as a Part Time-Seasonal General Public Works Labourer/Spare Operator, and;
BE IT FURTHER RESOLVED THAT the Reeve & CAO are hereby authorized to sign said agreement on behalf of the municipality.

7. W. Pacamaniuk – C. Eisner
WHEREAS the Community & Regional Planning Branch has reviewed the application for subdivision of PT NE ¼ SEC. 21-36-26WPM (Jersak) on behalf of the municipality and finds it to be in compliance with the Zoning By-Law for the RM of Minitonas;
AND WHEREAS there are no comments from any of the government departments or agencies in response to the above noted subdivision;
AND WHEREAS the application have been reviewed by the council of the RM of Minitonas, and found to be acceptable by the members of council;
THEREFORE BE IT RESOLVED THAT the Council of the Rural Municipality of Minitonas does hereby approve the subdivision of the aforementioned parcel of land as per the details submitted to the Municipality by Manitoba Local Government, Community Planning Services dated March 12th, 2014.

8. D. Klekta – E. Rinsdorf
WHEREAS the Town & RM of Minitonas have agreed to the joint purchase of two computer workstations to replace the existing equipment which has since become outdated and inefficient;
THEREFORE BE IT RESOLVED THAT we do hereby agree to proceed with the purchase as per the details attached hereto, sharing the costs on a 1/3 -2/3 basis in the same manner as joint office operating expenses.

9. W. Pacamaniuk – C. Eisner
WHEREAS, in accordance with Bill 33, Village of Bowsman, the Town of Minitonas and the RM of Minitonas are being forced by the Province of Manitoba into an amalgamation of the three municipalities and their two administrative offices, and;
WHEREAS the existing server needs to be replaced with an updated operating system to ensure the continuation of efficient operating and to provide larger capacity in order to accommodate the addition of the third partner and a fully operational satellite office, and;
WHEREAS agreement to the proposed cost sharing has been received from the Town of Minitonas, and agreement for participation from the Village of Bowsman has been requested;
THEREFORE BE IT RESOLVED THAT, since it is imminent to proceed with the purchase to set up the new server and begin the process of setting up new accounting software and the satellite office system in preparation for the amalgamation, and to avoid any possible issues with the Munisoft programming, we do hereby agree to proceed with the aforementioned purchase, and;
BE IT FURTHER RESOLVED THAT we do hereby agree to proceed with the purchase as per the details attached hereto, sharing the costs on the following basis;
– 50% paid by the RM of Minitonas $2271.00
– 30% paid by the Town of Minitonas $1363.00
– 20% paid by the Village of Bowsman $908.00

10. E. Rinsdorf – D. Klekta
WHEREAS the road repairs within the Rural Municipality of Minitonas as a result of the 2013 Flooding have not been completed, especially the major repair sites, and;
WHEREAS there will not be sufficient time for the municipality to complete said repairs and submit the claims for Disaster Assistance Funding in time for the June 10th, 2014 deadline;
THEREFORE BE IT RESOLVED THAT the Council of the Rural Municipality of Minitonas does hereby request that the Province of Manitoba – Manitoba Emergency Measures Organization approve an extension to the deadline for the 2013 Flood Repair Claim, and;
BE IT FURTHER RESOLVED THAT the extension be granted to provide for submission of all claim information by June 1st, 2015.

11. W. Pacamaniuk – C. Eisner
WHEREAS the Council of the Rural Municipality of Minitonas feels it is important to conserve the municipal gravel supply in order to maintain a local supply for municipal roads, and;
WHEREAS it is important to avoid significant increases in costs incurred as a result of purchasing and transporting gravel from areas outside the municipality, and;
WHEREAS the RM of Minitonas Council respects the need for ratepayers to access an affordable supply of pit run;
THEREFORE BE IT RESOLVED THAT pit run will no longer be made available from the RM of Minitonas Gravel Pit effective immediately, and;
BE IT FURTHER RESOLVED THAT RM of Minitonas ratepayers shall be allowed to remove pit run from the old ‘Renwer Pit’ and the old ‘Crown Pit’ free of charge until the supply has been depleted.

12. D. Klekta – W. Pacamaniuk
WHEREAS the Rural Municipality of Minitonas was approved for a grant in the amount of $25,000 for approximately 1800ft. of Rd#224N between Rd#153W & Rd#154W under the 2013 Municipal Road Improvement Program, and;
WHEREAS council has determined that it would be best to carry the project further and completely improve the problem area;
THEREFORE BE IT RESOLVED THAT the Council of the RM of Minitonas does hereby agree to apply for an additional grant for 50% of the attached quote to undertake the enhancement to an additional 1800 ft. of the aforementioned road under the 2014 Municipal Road Improvement Program.

13. D. Klekta – E. Rinsdorf
RESOLVED THAT, in accordance with Subsection 162(2) of The Municipal Act, a Public Hearing shall be held on April 23rd, 2014 at 7:00 pm in the Council Chambers of the Rural Municipality of Minitonas for the purpose of presenting the 2014 Financial Plan for the municipality to the general public and allowing any interested persons the opportunity to make representation, ask questions, or register objections to the proposed Financial Plan;
BE IT FURTHER RESOLVED THAT, in accordance with Section 420 of The Municipal Act, the attached Public Notice shall be placed on display in the community, in the local municipal office, in the local newspaper on April 8th, 2014 and April 15th, 2014, and on ValleyBiz from April 14th to April 20th, 2014.
