Town of Minitonas Minutes – November 6, 2013

Regular Meeting of the members of Council of the Town of Minitonas, held in the Council Chambers, Minitonas, Manitoba this 6th day of November, 2013 A.D. at 9:08 p.m.

1. J. Caruk – D. Bartel
RESOLVED THAT the Agenda be adopted as presented.
Carried.

2. S. Windsor – D. Bartel
RESOLVED THAT the Minutes of the Regular Meetings of Council held on October 2nd, 2013 & October 16th, 2013 and the Special Meetings of Council held on October 4th, 2013, October 9th, 2013 & October 16th, 2013 shall be adopted as circulated.

3. D. Bartel – J. Caruk
WHEREAS the purchase of a Kubota Diesel Front Mower – Model No. F3080 was approved by resolution No. 1, October 4th, 2013 and;
WHEREAS this model is no longer available for purchase;
THEREFORE BE IT RESOLVED THAT the Council of the Town of Minitonas does hereby agree to the purchase of a Kubota Diesel Front Mower – Model No. F3990 from Rough Country Sports as per the details attached hereto for the same price as originally approved.

4. S. Windsor – J. Caruk
RESOLVED THAT the Minitonas Town Council does hereby agree to place a joint ad with the RM of Minitonas in the Military Service Recognition Book as attached hereto.
Carried.

5. S. Windsor – J. Caruk
RESOLVED THAT the Council for the Town of Minitonas does hereby agree to place an ad in support of the Community Foundation of Swan Valley for a cost of $40.

6. J. Caruk – D. Bartel
WHEREAS additional work requested by the Waste Management Committee at the Minitonas Waste Management Site were determined to be outside of the monthly contract agreement;
THEREFORE BE IT RESOLVED THAT the Minitonas Town Council does hereby agree to the additional payment as attached hereto, and shall forward a recommendation for approval by the RM of Minitonas Council.

7. D. Bartel –S. Windsor
WHEREAS the Public Works Employee Overtime Reports have been received & reviewed by Council;
THEREFORE BE IT RESOLVED THAT all applicable overtime hours recorded for the month of October, 2013 shall be approved and paid out with the November 15th, 2013 payroll booked for future use as indicated on the aforementioned reports, copies of which have been attached hereto.

8. D. Bartel – J. Caruk
WHEREAS the Minitonas Town Council has determined that, under the terms of By-Law No. 2/2007, the condition of the attached property has become unsightly, a nuisance and possible danger to the public, and;
THEREFORE BE IT RESOLVED THAT the owner of the aforementioned property will be given written notice advising them that the condition of said property must be rectified by the deadline of November 15th, 2013, and;
BE IT FURTHER RESOLVED THAT, should the condition of the property not be corrected by November 15th, 2013 the Minitonas Town Council shall provide authorization for the work to be completed and the associated costs of said work shall be billed to the property owner accordingly.

WHEREAS all appeals to the 2014 Assessments have been satisfied and there are none outstanding;
THEREFORE BE IT RESOLVED THAT the Board of Revision scheduled for November 6th, 2013 is hereby cancelled and a letter of notification shall be sent to the Municipal Assessor with regards to the aforesaid cancellation;
BE IT FURTHER RESOLVED THAT the 2014 Assessment Roll for the Town of Minitonas shall be adopted as presented.

10. S. Windsor – D. Bartel
WHEREAS the attached offer to purchase was received by the Town of Minitonas, and;
WHEREAS the municipality intends to sell the property known as Lot 30, Plan 3129;
THEREFORE BE IT RESOLVED THAT the Minitonas Town Council does hereby approve the sale of the aforementioned lot for $100 plus legal costs under the terms and conditions outlined on Schedule ‘A’ attached hereto.

11. D. Bartel – S. Windsor
WHEREAS a By-Election to fill the vacant position of Councillor for the Town of Minitonas was held under the requirements of Subsection 105(3) of the Municipal Act and in accordance with the regulations under the Municipal Councils and School Boards Election Act, and;
WHEREAS no nominations were received by the deadline of October 28th, 2013 and;
WHEREAS there is still a majority of the number of members compromising the council and less than 12 months until the next Municipal Election;
THEREFORE BE IT RESOLVED THAT the Minitonas Town Council does hereby agree to continue operating until the October, 2014 Municipal Election as a council of 4 members under the authority of Subsection 105(1) of the Municipal Act.

12. J. Caruk – D. Bartel
RESOLVED THAT Councillor Steve Windsor shall hereby be appointed to represent the Town of Minitonas on the LP Liaison Committee.
Carried.

13. S. Windsor – D. Bartel
RESOLVED THAT Council for the Town of Minitonas does hereby authorize CAO, Carolyn Gordon to register the municipality on ‘Municipal Classified.ca’ under a Lifetime – No Charge Bronze Account.
Carried.

14. J. Caruk – S. Windsor
RESOLVED THAT the date of November 27, 2013 shall be set for the Town of Minitonas Strategic Planning Meeting.
Carried.

15. S. Windsor – D. Bartel
RESOLVED THAT the date of December 4th, 2013 at 7:00 pm shall be suggested for the Town & RM of Minitonas Joint Meeting and forwarded to the RM of Minitonas Council for confirmation of the date.
Carried.

16. S. Windsor – J. Caruk
RESOLVED THAT we do now adjourn at 10:45 pm., and;
BE IT FURTHER RESOLVED THAT, due to a conflict with the date of the Village of Bowsman Amalgamation Meeting, we do hereby agree to meet again for the next regular meeting of Council to be held on the 27th day of November, 2013 A.D. at 7:00 pm.
